into the hundreds, but would
not estimate the amount of
money they represented,
saying it would be in the
thousands of dollars.
She pointed out that the
business handled by the
county judge and the county
attorney had increased some
four or five times in a year,
taking for examples the
minutes of the county court
for August, 1963, when the
minutes required five and a
half pages, while in August
of this year twenty-six and
a half pages were required.
“And, that,” she ex-
plained, “was ninety per
cent cold checks.” *
Warren Tabor said that
about all he was handling
now was cold checks. “We
have a workable and en-
forceable cold check law,”
he declared, “If we can find
the ones who gave the
checks. Much of the loss
merchants suffer from this
swindle is the fact they do
not require sufficient identi-
fication, and second, when
a p erson has been brought
before them they cannot
identify him as the one who
gave the check. Without
identification we cannot
prosecute. ”
Louis Owens, county
judge, pointed out another
phase they are meeting with.
“Many of the merchants,”
he stated, “are extending
credit through taking checks
for merchandise and allowing
the signer of the check to
pay the check out on in-
stallments. A check which
has been pirtially paid can-
not be filed on—it becomes
just another piece of paper.”
“We have no choice but
to dismiss such cases.”
As a means of putting an
end to this growing racket
it was suggested that first
know your man or woman, be
sure if the check is not good
you can identify them—but,
best of all, if you have any

doubt, call the bank the
check is drawn on. If it is
not ona local bahk refuse
to take it unless you know
the one giving it.

Mooney on the other. Near-
by was a spring from which
both families carried water.
On the fateful day my mother
went to get water as usual,
only to find the fence a-
round it secured with strong
nails. My father told her
to climb over it, but it was
too high.
“My father tried to tear
the wires loose, but failing
to succeed he started to
climb over it. Just as he
threw his leg over the top,
Mooney stepped out in sight
and shot him. The gun was
loaded with slugs, and one

behind him. My father
passed away that night, and
mother a few days later.
“Mooney got away. My
oldest brother tried to find
him, but was unsuccessful.”
Soon after this the Harp
children were adopted out to
different fanilies, and if
was 43 years later before
they again met. A war
veteran and wife, W. H. and
Mary Jones, an elderly
couple, took Mr. Nichols,
and were very good to her.
“A very happy time,”
continued Mrs. Nichols,
“was when, a short time
before my marriage, I was
allowed to ride a beautiful
black horse at the State Fair
in a parade at Shelbyvtlle,
Tenn. The horse was from
Dallas, Texas and x *on a
blue ribbon. Dr. Sharp, our
family doctor, rode by my
side.”
| Soon after this Mrs.
Nichols married Dennis
Baxter, and they were very
happy on a farm. In 1908
they came to Texas, settling
at Charley, and stayed two
years. Then they moved
back to Good Springs, Tenn.,
and in 1912 they moved to
Alabama.
Mrs. Nichols continued,
“We moved back to Good
Springs eight years later
where we farmed until my
(husband was killed by Hor-
ace Rose.
“It was an accident,
My oldest son was haviig an
argument with Rose and my
husband went over to see
if he could settle the
trouble. He hot our son to
go back in the house and
was walking by his side
when the shot was fired. It
was intended for our boy,
but it killed my husband.”
Mrs. Nichols told of a
devastin

Tennessee:
“We were living between
Minor Hill and Claska, Tenn,
at Bethel Springs. Two
clouds came together almost
over our house, one from the
south and one from the north.
For a moment they boiled
and rolled, then a tail shot
earthward. It passed our
place without striking the
ground, but a little way from
us it killed five families and

Ken has been in bus-
iness in Levelland for the
past ten months and carries
a complete line of groceries
and in addition cooked food
to go, such as barbeque,
hamburgers and hot dogs.
Ken is married and is
the father of two fine boys,
Joe, 16 and Craig, 10.

“When I was small I
remember Jesse James
eating dinner at our house,
and visiting with my father.
With him were Frank
James and Cole Younger.
Years later, when we lived
at Charley, Texas we went
to Lawton Okla., and saw
Frank James, Cole Younger
and little Jesse. Frank and
Cole were old men then.
“After my husband was
killed and the children were
married, I came to Lubbock
in 1942 where I married J. D.
Nichols. Except for one
year when we lived In Tenn-
essee, we have lived in
this section, the past twelve
years in the Ropesville
community."
(But trouble was still
dogging Mrs. Nichols’ foot-
steps.)
“One day we went to
Levelland to have my teeth
pulled and on the way home
we had a car wreck at Smyer.
I was taken to a hospital at
Levelland where I remained
for 31 days. I have had to
use crutches some of the
time since.”
