Code, not upon personal feel-
ings about the men and women
who are parties to the divorce.
The matter of child custody,
for instance, is to be decided
according to the “best interests
of the child,” not according to
the gender of the parent or
child. The debts and assets are
to be divided “fairly and
equitably” — and again with-
out prejudice for husband or
wife.
Q: I have some probate
questions. Must property
jointly held by spouses be in-
cluded in an estate inventory?
What difficulty would a lay-
person have in probating a sim-
ple will in which the surviving
spouse is named the only
inheritor?
A: Jointly held property
must be included in the dece-
dent’s estate to the extent he
owned that property. If, for in-
stance, he owned a farm equal-
ly with his two sisters, one-third
the value of the farm would be
in the decedent’s estate.
A simple Will — that is, one
without a trust, might be pro-
bated without a lawyer. How-
ever, I would still advise you to
have an attorney draw up the
papers transferring joint prop-
erty into the name of the sur-
viving heir.
Q: What is meant by the
term “mental anguish”?
A:. When connected with a
physical injury, this term in-
cludes both the mental sensa-
tion of pain and the accom-
panying feelings of distress,
fright, and anxiety. In other
connections, and as a ground
for divorce for damages or as
♦ an element of damages, men-
tal anguish includes the suffer-
ing resulting from the more
poignant and painful emotions
such as grief, severe disap-
pointment, indignation,
wounded pride, shame and
public humiliation.
Q: I bought a car last year
on credit but I still haven’t
received any papers to show
that I own it. Isn’t the car lot,
by law, supposed to give me a
—copy of the title?
A: Yes, you should have

System, to wit: improvements to gas system facilities,
including the drilling of a gas well, paying contracts for
professional services, such certificates to be payable from
ad valorem taxes and a lien on and pledge of the net
revenues derived from the operation of the City's com-
bined Waterworks, Sewer and Gas System. The certifi-
cates are to be issued, and this notice is given, under and
. pursuant to the provisions of Article 2368a. 1. V.A.T.C.S.
