Sec. 5. Subject to the terms here,
of the governing body of any city
shall have power to assesss against
tbe owner of any railroad or street
railroad occupying any h’ghway or-
dered to be improved the whole
cost of the improvement between or
under the rails and tracks of said
railroad or steet ra'lroad and two
feet on the outside thereof and shall
have power by ordinance to levy a
special tax upon said railroad or I
street railroad and its roadbed, ties !
rails and fixtures, rights and fran - !
chises. which tax shall constitute a
lien thereon superior to any othe’
lien or claim except state, county or
municipal taxes and which may be
enforced either by sale of sa'd prop-
erty in the manner provided by law
in the collection of ad valorem tax-
es by the city or by suit against the
owner in any court having jurisdic-
tion. The ordinance levying sal I
tax shall prescribe when same shall
become due and delinquent and the
method or methods of enforcing the
same.

made common cause to have Sec. 7
of the adm'nistration rate bill strick-
en out. The article also charged that
the Senate leaders proposed to the
democrats that their amendments ba
withdrawn, the insurgent amend-
ments voted down and then all the
bill killed except Sections 8. 9 and
10. The article was not denied.

6. Subject to the terms
hereof the governing body of anv
city shall have power by ordinance
to assess the whole cost of construct-
ing sidewalks or curbs, and not to
exceed three-fourths of the cost of
any other Improvement, against the
owners of property abutting on such
improvement and aganst their abut-
ting property benefited thereby, and
to provide for the time and terms of
payment of such assessments and
the rate of interest payable upon
deferred payments thereon, which
rate of interest shall not exceed 6
per cent per annum, and to fix a
lien upon such property and declare
such assessments to be a persona!

body shall have power to cause to
be issued in the name of the city as-
signable certificates declaring the
liability of such owners and their
property for the payment of such
assessments and to fix the terms and
