of J. B. Moore today. Six of them
were members of Moore’s family and

tion of this Citation once in each

there be no newspaper published in

of Denton county, to be holden at
the Court House thereof, in Denton
on th., sixth Monday after the sec-
ond Monday in July, 1912, the
same bein^ the 19th day of August,
1912, then and there to answer a
petition filed in sa d -our* on the
4th day of June, 1912, in a suit
numbered on the docket of said
Court No. 5517, wherein J. W. De-
gan is Plaint'ff, and Eli Pickett, if
living, and of Augustus G. King if
living, and if dead then of the un-
known heirs of said Wm. K ng and
Augustus G- King; of Stephen Hiatt,
if living, and if dead then of the un-'
known heirs of said Stephen Hiatt
are defendants, and sa d petition a)
leging that for cause of a> on plain-
tiff shows to the court that he is
possessed of and owns In fee sim-
ple the follow ng described tract of
land, to-wit: 320 acres of land
situated n Denton county, Texas,
on the waters of Elm fork of the
Trinity river about 9 miles south,
31 degrees east from Alton, and em
bracing the east half of section No.
15. township 3 north of first base
line in Range 2 west of the first
mer dian and bounded as follows:
beginning at the sou'hw'est corner
of a survey of 318 acres made from
Augustus G. King a stake ia prairie;
thence south 9/5 varas to timber,
1900 varas a stake from which a
post oak marked X bears north 30
degrees east 3 varas, a post oak
marked X bears south 10 degrees,
west 2 varas; thence west 950 varas
a stake from which an elm marked
X bears north 64 degrees west 9
varas, a cottonwood mdirked X
bears south 7 degrees west 11 varas;
thence north through brush and
timber 365 varas prair e. 900 varas
to timber, 1141 varas prairie, 1900
varas a stake in mound; thence eas<
950 varas through prairie to place
of beginning.
Plaint ff shows to the court that
the above tract of land wa* on the.
23 day of May, 1854, patented to
said Eli Pickett. That at some
time between the 23rd day of May,
1854, and March the 7th, 1855, the
said Eli Pickett by hfs deed in writ-
ing, duly executed and delivered,
conveyed said land to Wm. King;
and Augustus G. King; that if said
deed was ever placed of record in .
Deaiton Co., Texas' that the
thereof was destroyed by
the burning of the Denton county
That the original from
the sa d Eli Pickett to Wm. King
and Augustus G. King has
since been lost or destroyed,
the destruction of said deed and
the record thereof casts a cloud
upon the title of this plaintiff.
Plaintiff further shows to the
court that on the 22nd day of Jan-
uary, 1855. Wm. King and Augustus
G. K ng, who at that time owned
aud possessed the land hereinbe-
fore described in fee simple, made,
executed and delivered their bond
for title to Stephen Hiatt: that said
bond for tlt’e i* of record in Den
ton county. Texas, In Vol. A-3, page
317, but that if the Mid Wm. King
and Augustus G. King ever execut-
ed to the said Gtqphen Hiatt any
deed to said land then the deed
and the record thereof have been
destroyed. Plaintiff shows to the
Court that acting under said bond
for t tie the said Stephen Hiatt
went into possession of said land
and afterwards sold and conveyed

ton county. Texas, but that said
deed and the record ’hereof from
said Hiatt to said Caudle have been
destroyed and are not now in ex
istence. That plaint ff claims title
through and under each of the deeds
of conveyance* hereinbefore* men-
tioned and that loss and destruction
of each one of said deeds and of
its record casts a cloud upon the
title of this plaintiff to the land
hereinbefore deocribed.
Plaintiff further show* to the
Court that he and those under whom
h* claims have been in peaceable and
adverse possession of the land and
premises hreinbefore described un-
der title or color of title for more
than three year* ptfor to the in-
stitution of this suit, and has been

joying the same and paying taxes
thereon, and the plaintiff is claim
Ing the same under the five and
ten years statute of 1 mitation, prior
to the institution of this suit.
