the system that we have been liv-
ing with for over twenty years, it
is a system that has served the
majority of students in the state of
Texas well and been very responsi-
ble to the taxpayers of the state.
For DeLeon ISD. this system was
a benefit for our students, teachers,
and community as a whole.
However, the battle did not
simply end with the Edgewood.
One consequence of the finance
system that developed out of the
Edgewood suits and the lack of
state support for public education
was the gradual rise of local school
district property taxes to the statu-
tory limitation of $ 1.50 per $ 100 of
property value. This consequence
has eventually germinated into a
new round of school finance law
suits known as “West Orange
Cove.”
This lawsuit, filed back in
2003, was a little different from the
first round of school finance court
battles. In Edgewood the suit was
brought by property poor school
districts that were not receiving an
equitable amount of state funding.
West Orange Cove was filed by a
group of property wealthy school
districts that claimed that the state
has imposed a statewide property
tax by requiring school districts to
tax at the legal limit of $1.50 to
have enough funds on which to
operate.
The case of West Orange
Cove was heard in a Travis County
courtroom beginning in August of
2004 and was concluded in
October of 2004. On the day of the
verbal ruling by the judge, the state
began to come under pressure
from the courts to the fact that they
had definitely imposed a statewide
, property tax on taxpayers across
the state.
As was expected and had
been seen in every other schcxvl
finance lawsuit, the result of the
case was appealed to the Texas
Supreme Court with the case being
heard in July of 2005. The
Supreme Court then rendered a
decision in November of 2005.
