there to answer the suit of Wm.
Schwarz and D. Dreben partners and
doing business under the firm name of
Cooke County Liquor Co., plaintiffs,
against R. E. Russell and W. M.
Blundell, defendants for the sum of
Twenty-five dollars, besides interest,
costs and attorney’s fees, instituted
upon a note dated April 28th, 1908 and
due eight months after date, with in-
terest thereon at the rate of 8 per cent
per annum from date, and an addi-
tional sum of 10 per cent for attorneys
fees, if placedin the hands of an attor-
ney for collection after maturity, the
same being one of a series of 8 notes
given by said W. M. Blundell to The
Brunswick-Balk Collender Co., and
which note plaintiffs have boughtfrom
said Company, and is the legal owner
and holder of the same and which
plaintiffs allege, R. E. Russell defend-
ant assumes payment of, for value.
Tha! aid note is secured in the pay-
ment thereof, by a mortgage in writ-
ing, executed by said W. M. Blundell
to said The Brunswick-Balke Collen-
der Co., of even date with said note,
on one 4x8 C. Elm Century 6 pocket
Pool Table. 1 dozen cues, 1 cue rack, 1
brush, 1 ball rack and one set of com-
position pool balls. Also alleging
other indebtedness against the said R.
E. Russel), defendant, in the sum of
$11(1.00, besides interest; all of which
is due and unpaid.
