Below will be found the ruling
referred to on the editorial page
from the attorney general of
Texas about this county division,
and from it one can readily see
that the only way possible to di-
vide the covnty would be for
Bowie to get enough of Clay
county, and for Nocona to get
enough of Cooke county to make
up the 424 square miles of terri-
tory which we are short of being
able to make two counties out of
Montague. Clay county could
give us the whole of 424 miles
and not miss it, and if Bowie can
work her rabbit foot along this
line we are sure that our people
will be willing to do the right
thing. Read the opinion and
then see if you think there is any
way yossible to have two coun-
ties, and give Nocona as well as
Bowie a county seat. If it is
possible of course it should be
done, for Nocona and Bowie both
ought to have a hundred thous-
and dollar court house each.

Dear Sir:—We have your letter
of the 20th instant, in which you
write: “Will you please give the
undersigned the opinion of your
Department as upon the legality
of dividing Montague County,
Texas, and if it is possible under
the statutes and Constitution,
provided that the people of the
county are in favor of division?’’
This Department ordinarily
declines to give official opinions
to private persons; however,
since the question addressed to
us by you is of some public im-
portance to the citizens of your
county, we will make an excep-
tion to our rule in this instance.
You are advised that Section
one of Article 9, State Constitu-
tion provides:
“The legislature shall have
power to create counties for the
convenience of the people, sub
ject to the following provisiona:;

no new county shall be created
with a lean area than upven hun-
