The governing body of the
City of Aspermont, Texas, has
heretofore ordered that the fol-
lowing described portion of
Broadway (U.S. Highway 380)
in and along the boundaries of
the City of Aspermont, Texas,
be improved by installing con-
crete curbs and gutters, and it
is hereby found and determined
that the cost of improvements is
the amount hereinafter set forth
covering the paving improve-
ment. unit herein described, and
the amount per front foot in
such unit proposed to be assess-
ed for such improvements
against the abutting property
and the owners thereof shall not
exceed $2.10 pot' front foot; the
properties and unit, and the
estimated cost of improvements
being as follows, to-wit:

merits for the making and. con-
struction of such curb and gut-
ter improvements have been
made and entered into by the
City of Aspermont, Texas, and
rolls and statements showing
the proposed amounts to be as-
sessed against abutting property
and owners thereof have been
filed with the City, such rolls
and statements showing other
matters and things, and have
been approved & City Council
of said City has fixed a time and
place for hearing to the owners
of property abutting upon said
portions of streets, highways and
avenues and to all others af-
fected, at which hearing the
amounts to be assessed against
the respective parcels of abut-
ting land and the owners there-
of, for such curb and gutter
improvements, the amounts of
benefits to the respective parcels
of property by means of im-
provements in the above des-
cribed unit upon which the par-
ticular property abuts, the regu-
britv of the proceedings with
reef re nee to such improvements,
the apportionment- of the cost
of such improvements, and other
matters a'i.1 things will be deter-
mined. After such hearing, as- >
sessment-; will, by ordinance, be
nv.de and levied and such hear-
ing wi 11 be had and held by and
before the City Council of the
City of Aspermont, Texas, in the
City Hall in said City on the
27th day of September, 1905, at
7:00 o'clock P.M. The rolls and
statements showing the proposed
amounts of such assessments are
on file in the office of the City
Secretary and open to inspection
of any interested parties at any-

way Department of the State of
Texas for Broadway (U.S. High-
way 380), and to secure the pay-
ment by the State of Texas of
as much of the cost of said im-
provements as is possible under
the law, but to provide a means
of securing the City in obtaining
from abutting property owners
as much of the cost of such im-
provements as is possible under
the law and as may not be paid
by the State.

as, this 7th day of September,

No notice other than herein-
above provided for shall be
necessary, but such notice shall
be due and sufficient notice to
any and all other persons, firms,
corporations, and other parties.
That a hearing be given and
held by and before the govern-
ing body of the City of Asper-
mont. I tis. to all persons own-
ing or claiming any property
abutting any part or portion of
Broadway i U.S. Highway 380),
lescribi ii in Section 2 of this
Resolution, as well as owning
and claiming any interest in
meh property, such hearing to
be given and held on the day,
at the time .and at the place des-
cribed in the text of the notice
in Section (2) above, and the
City Secretary is hereby direct-
ed.to give notice of the time and !
place of such hearing, and of
other matters and facts in ac-
cordance with the terms and
provisions of the laws of the
State of Texas and Article
1105B, Texas Revised Civil Sta-
tutes ,1925 as amended, by ad- j
vertisement inserted at least
three (3) times in The Asper-
mont Star, a newspaper publish- i
ed in the City of Aspermont,
Texas, the publication to be ;
made at least ten (10) days be-
fore said hearing. Said notice
shall comply with and he in
accordance with the terms and
provisions of this resolution and
said act as amended.
On motion of Councilman B. J.
Griggs, seconded by Councilman
J. M Hickman III, the foregoing
resolution was passed on this
the 7th day of September, 1965,
as shown by the following vote:

substantially as follows, to-wit:
Suit in trespass to try title for
the title and possession of the
following described lands and
premises, situated in Stonewall
County, Texas, to-wit: 1
All of Lots Nos. Seven (T), J
Eight (IB, and Nine (9), in I
Block No. Thirty-eight (38) of
the Original Townsite of the
City of Aspermont, in Stone-
wall County, Texas, same be-
ing a part of Section No. 122,
Block "D", H. & T.C. Ry.
Company, Certificate No. 30/
2543.
Plaintiff specialy pleads the
five and ten year statutes of
limitations of the Stute of Tex-
as, as a basis for his title to said
lands and premises, and prays
that on final trial, he have judg-
ment against the defendants,
and each of them, for the title
and possession of said lands and
premises, and thiat writ of res-
titution issue, and for rents,
damages and costs, and for all
such other and further relief,
general and special, legal and
equitable, to which he may show
himself justly entitled, as is
more fully shown by plaintiff's
petition on file in this suit.
If this citation is not served
within 90 days after the date of
its issuance ,it shall be returned
unserved.
The officer executing this
writ shall promptly serve the
same according to the require- ^
nicnts of law, and the mandates!
hereof, and make due return as
the law directs.
Issued and given under my
