were looking for a stolen car. They
later claimed that Hiighes opened fire
and fled. Hughes claimed that he
didn't have weapon. Hughes was
convicted and added to the list of
condemned Texas prisoners.

political skills may be tested even
more severely as he tackles the many
problems that await solution.
Texans need to rally behind Gover-
nor White and his administration to
keep the state moving forward and ad-
' dressing its own responsibilities. That
does not mean all of his programs
should, or will, be accepted without
question. But they should be carefully
weighed and the programs with merit
incorporated into the system.
Schwen could not work on behalf of an
individual prisoner. So, she founded a
non-profit corporation last spring
which had as its specific goal aiding
BiUy Hughes in his appeals and his
efforts for a retrial. Hughes, mean-
while, continued to publish a hor-
seowner’s stable guide, a newsletter
and his upbeat, humorous “Happy
Horse” cartoons which he sold to any
number of Western magazines and
horse related periodicals. And he
corresponded regularly with the
Schwen family, among others.
Marcia Schwen toyed with the
wrapped Christmas present. She had
never heard of Jean Gould. “But I’m
used to getting mail for Billy.” she
said. “I assumed that another friend
of BiUy’s told this Jean Gould that she
could send me the thinJ and that I’d

In his State of the Judiciary address
to the Texas Legislature, Texas
Supreme fourt Chief Justice Jack
Pope offered pertinent evidence to the
lawmakers about a growing state pro-
blem. Texas courts are being inun-
dated with new cases. He said that
nearly a million cases a year are going
' to the trial courts in Texas.
And the rush to litigate has created
a tremendous backlog in appellate
courts.
He noted that while the 14 Courts of
Civil Appeals are now empowered to
relieve some of the litigation formerly
going to the Texas Court of Criminal
Appeals, the backlog remains in a
volume that appears as high as a
mountain. For example, the Texas
Court, of Criminal Appeals received
1,237 cases last year.
