Settlements of the suits instituted
by the Markham Rice Milling Com-
pany against a number of insurance
companies are fast being consummat-
ed in the District Court of Harris
County and the causes being dismiss-
ed. Six cases were disposed of in
the Fifty-fifth District Court Monday
following a settlement in each and
the actions dismissed at the costs of
the demendants. They were suits
against the British American Assur-
ance Company, the Liverpool, London
and Globe Insurance Company and the
Citizens Insurance Company.
These cases are the first batch of
52 petitions which were filed in the
fall of 1911, following the fire which
destroyed the plant of the company
at Markham, Texas, and consumed a
large amount of stock. Upon the re-
fusal of the insurance companies to
settle, suits were commenced and the
first case tried early this year. This
resulted in a verdict in favor of the
plaintiff, and it was agreed that the
other suits would be settled on a
proportionate basis to the amount of
the first petition. The entire amount
sued for aggregated about $150,000,
and it expected the settlements
reach the sum of $130,000.

The Colorado River at this place is
gradually rising and the situation is
becoming more and more serious. The
protection levee which runs parallel
with the river for a distance of twelve
miles on the Bay City side, is still
holding and Commissioners V. L. Le-
Tulle, D. P. Moore and A. A. Harty
have one hundred men at work build-
ing it up in the low places.
No danger was anticipated, how-
ever, until this morning, when news
of recurring floods reached here from
Columbus, Austin and other points
above.
At Columbus the river is 34.6 feet
and still rising.

Moses Abbot are defendants, said pe-

dated March 8, 1910, at Palacios, Tex-

uated in Matagorda County, Texas, to-
wit: Beginning at the northwest cor-
ner of the 410 acres of land in Yea-
mans 1-3 league sold by H. M. and E.
M. Yeamans to M. Lipscomb, at a
stake in the center of graded roads for
N. W. corner; then S. along center
of said road 833.04 varas to the S.
W. corner; thence E. 1355.3 varas to
the west line of Stallard and Ander-
son’s west line; thence N. 833.04 varas
to the N. E. corner; thence W. along
the line of the T. R. D. Co., to the
place of beginning at the N. W. cor-
ner, containing 200 acres according to
the J. C. Carrington subdivision map,
as per deed recorded in Book 29, page

That by reason of the execution of
said notes, the said R. F. Bode, or his
heirs or assigns, became bound to pay
to the said M. Lipscomb the sums of
money in said notes specified, togeth-
er with interest and attorney’s fees
according to their effect and tenor.
That subsequently the said R. F.
Bode died, leaving a will in which Al-
exander F. Bode was named as execu-
tor, and the other defendants herein
named together with the said Alex-
ander F. Bode as his heirs; that the
said R. F. Bode was sometimes known
and designated as Reinhold F. Bode,
and that R. F. Bode and Reinhold F.
Bode, are one and the same person;
That said notes are due and unpaid;
and plaintiff is the legal and equitable
owner and holder thereof; that the
defendants, though often requested,
have failed and refuse to pay the same
or any part thereof, either principal
or interest to plaintiff’s damage in
the sum of $5400.00; that after the ma-
turity of said notes and default made
in their payment, plaintiff placed the
same in the hands of Gaines & Cor-
bett, practicing attorneys of Mata-
gorda County, Texas, and have agreed
to pay said attorneys the 10 per cent
stipulated in said notes as collection
fees: that it was necessary to place
same in the hands of attorneys for
collection and that these proceedings
had been instituted for the collection
of the same and the sum agreed to be
paid said attorneys is reasonable com-
pensation for the services to be per-
formed: that defendants have failed
and refused to pay said attorney’s fees
or any part thereof to further damage
in the sum of $540.00.
That said R. F. Bode departed this
life in the county of Niagara, North
Dakota, on June 2, 1910, leaving sur-
viving him the following as his heirs
and sole legatees: Mary Bode, wife,
Alexander F, Bode, .Valter C. Bode,
Louis Bode, Oscar Bode, sons, Flor-

Beaumont, Texas,—December
The directors of the Southern
Growers Association today raised the
minimum price of Honduras 15 cents
and on Japan’10 cents. The prices
will be effective Decemoer 15. They
are: Honduras No. 1, $3.65; Japan
No. 1, $3.10, with proportionate prices
for lower grade#.
Dr. A. C. Wilkins formally tendered
his resignation as secretary and it
was accepted. He resigned as mana-
ger several months ago and since then
has not been active in the association.
He was succeeded in both offices by
E. A. Eignus. Regardless of the fact
that the recent rains caused anothei
setback to the rice crop and neces-
sarily caused more loss, the directors
look at the situation optimistically
and believe that the prices set by the
association will be maintained.
