a one-day conference of the freight
claim prevention committee held Sat-
urday nt the Texas Hotel.' About
fifty representatives of Texas lines
of the railroad were in attendance.
The problems of minimising freight
claims were under discussion, and
ways and means of preventing ex-
cessive claims were considered. H.
E. McGee, general manager of the
Katy lines was in charge of the con-
ference. Every phase of freignt'
claims was discussed, aud report^!
were made by each commodity
chairman. Considerable . discussion
was made on claims arising from the
shipping of livestock in unclean cars.

After the still was located. Ross
showed the officers the location of
the whiskey, and gave them other as-
sistance, declaring he was ready to
give up. That he had been manu-
facturing whiskey for two years but
had been expecting arrest sooner or
later was another statement the man
made. The fact that there was good
money in < illicit business was given
as the reason for continuance of the
liquor making.

The Bed River Valley Fair Bolst-
ers together with the Sherman Mun-
icipal Band will arrive in painesville
about 3.30 o’clock and give a short
concert, according to a lettqj receiv-
ed by the Chamber of Commerce
from L. L. Etchison, secretary of the
Fait. Association. The Boosters are
coming to Gainesville from Valley
View, expecting to visit SouthmafVd,
Collinsville, Tioga, Pilot Point and
Denton in the morning, and Sanger,
Valley View, Gainesville and Whites-
boro during the afternoon.
The Red River Fair is to be big-
ger and better than ever this year,

, The sheriff's department dis<?Oy-

six miles southeast of Valley Vm9
Sunday, and promptly confiscated’ ft
and brought it to town. Tire still
is one of the best ever captured here,
officers state, and is - of 15-gallon
capacity. There was no mash or li-
quor in the vicinity of the still
found, but several barrels and other
accoutrements indicated that the
still had been in operation for some
time.
The owner may have the still if

davit as to its ownership, Deputy
Sheriff Jack Glasgow says, who also

at one place, a copper worm was de-
stroyed at another, and one arrest
made in the joint cleanup drive made
by officers of Grayson and Cooke

junction granted the city of Denison
by Pearman several weeks ago, which
restrained the Municipal Gas Com-
pany from assessing and collecting a

Twenty-one North Texas
were interested in the case and- are
effected by the decision. Had Denison
won out, or if it wins out on the ap-
peal, it will mean the discontinu-
ance of the charge in all cities sup-
plied by the Municipal Gas com-
pany.

C. P. Pearman of Gainesville, sitting
as special judge in the Fifteenth
1 District Court, refused to continue
| in force the temporary injunction
which he had granted several weeks
ago, directed against the Municipal
Gas Company, cutting off any pa-
trons at Denison who might refuse
to pay the company’s ready-to-serve
charge, at the conclusion of argu-
ments shortly before noon Saturday,
i on the motion of the gas company
to dissolve the injunction.

case contended in the hearing. The
right of the gas company to collect
a ready-to-serve charge has been ap-
. proved by the State Railway Com-
mission. but the entire powers of
this body in regulating rates under
the Cox biU was attacked as being
j unconstitutional by Hamp P. Abney,
counsel for the cities, on the grounds
that the duties of the Railway Com-
mission are fixed by the Constitu-
tion, and these duties may not? be
added to or changed by legislative
enactment.
Mr. Abney said after the hearing
that his next step in the matter will
| be an appeal to the Court of Civil
I Appeals at Dallas.
The Municipal Gas Company was
required, under Judge Pearman’s rul-
ing. to furnish bond of $10,000, pro-
tecting Denison gas users from any
loss through payment of the ready-
to-serve charge should a higher court
reverse the ruling made by Judge
Pearman and declare the law under
which the charge is made unconsti-
tutional.
