of beginning, containing 33 acres of
land, more or less.
Plaintiff further alleges in the al-
ternative, that if he be mistaken in
the foregoing allegations, then he is
the owner of the fee simple title to
the real property hereinabove de-
scribed, and is in possession thereof,
and holds title as against each and all
of the defendants above named.
(1) He alleges that he, and those
under whom he deraigns title, have
had and hold continuous, peaceable
and adverse possession of said prop-
erty, cultivating, using and enjoying
the same, and paying taxes thereon,
claiming and asserting absolute title,
thereto under deeds duly recorded in
the Deed Records of Grayson Coun-
ty, Texas, for more than five (5)
years next preceding the institution
of this suit, and claims and asserts
title thereto under the Statute of
Limitation of Five Years (Art. 5509,
R. C. S., 1925).
(2) The plaintiff and those under
whom he deraigns title to said real
property, have continuously had and
hold peaceable and adverse posses-
sion of said real property, cultivating,
and using and enjoying the same, for
more than ten (10) years next pre-
ceding the institution of this suit, and
plaintiff claims and asserts title to
said real property under the Statute
of Limitations of ten (10) years (Art.
5510, R. C. S., 1925).
(3) That plaintiff and those under
whom he deraigns title have contin-
uously had and hold peaceable and
adverse possession of said real prop-
erty for a period of twenty-five (25)
years prior to the filing of this suit
under claim of right in good faith,
under deeds and other instruments
purporting to convey said real prop-
erty, duly recorded in the Deed Rec-
ords of Grayson County, Texas, and
have title to said real property under
the provisions of Article 5519, of the
revised Civil Statutes of the State of
Texas (1925), and amendments
thereto.
(4) That the possession of said
land by plaintiff and those holding
in privity with him, has at all times
been peaceable, open, notorious and
hostile to the claim or claims of the
defendants, and all other persons
claiming or asserting any title or in-
terest in and to the title to said real
property.
(5) That the plaintiff, and those
under whom he deraigns title, have
openly exercised dominion over, and
have asserted claim to the above de-
scribed real property, and have paid
taxes thereon annually, before be-
coming delinquent, for more than
twenty-five (25) years, and that
those holding the apparent record
title to said real property, or any
portion thereof, have not exercised
dominion over said land, or have not
paid taxes thereon, one or more years
during the period of twenty-five (25)
years next preceding the filing of this
suit.
(6) That the defendants, and each
of them, claim and assert title to an
interest in said real property, which
constitutes a cloud on plaintiff’s rec-
ord title to said real property. The
exact nature of the claims so as-
serted by defendants, and each of
them, is unknown to plaintiff, but he
alleges that such claim or claims so
asserted by defendants, and each of
them, is inferior to the claimed title
of the plaintiff to said property.
Plaintiff desires, and is entitled to
have, said cloud removed, and his

from, and unlawfully withholds from
him the possession thereof, to his
damage in the sum of $500.00 dam-
