Supreme Court Justices
Scrap in Private Sessions
I BY PETEK EDSON
NEA Washington Correspondent
TT'ASHIN'CTON—(N'KA>—The U.S. Supreme Court—which re.
turns to bat at World Series time every year—is more steei >n
in tradition than any other branch of government.
TI us. trie ' y ten. by which the court decides which justice sha '
\Viite what particular majority opinion was set in iT'ttt by C li e:
Justice John Mar-hall, the lust of only 14 to hold that 1'iyn olli. *
The court normally sits from Monday through Thursday dur:t
its October to June term. On Fridays trie justices! hold an all-i'a
conference to discuss the cases they have heard.
Oil the record, it is admitted that the justices tight like cats an.t
.logs in these Friday sessions, arguing for points oi view* as onl\
lawyers can. But every one of the nine justices, from the thi.-t
justice to the mo t jiuuoi' associate justice cu. the bv ik:;, expicsses
his opinion in turn.
THEN A TENTATIVE VOTE is taken. This is recorded Thi
senior justice in point of service on the majority side then selects
one of the four or more who voted with him to draft the court
tinal opinion.
Tl^is draft, when finally approved, is printed in the basement
of the Supreme Court building. For the lirst 75 years ol it- history,
this job was done by a private printer. It is now handled by a
small, select ami devoted >t;dl assigned from Government Printing
Office.
One of the most significant sidelights on the work of this group
is that in the court's !tiK years, there has never been one leak on
an opinion before it was read and released from the bench.
BECAUSE OF T!IE JUSTICES' many bitter arguments over caces,
Chief Justice Melville W. Fuller, who served from 1888 to UHo.
instituted the custom of having every justice shake hands with
every other justice jutt before they go on the bench or into then
Friday conferences.
One of the brain teasers which justices like to throw at then
guests is how many hand shakes are involved in this cerenu.ii\
The lirst answer that most people give is that it would be nun-
times nine, or 81. But that would make every justice shake liam!
with himself. I* isn't eight times nine, either. The correct nuinl.ci
is :iG. Figure it out yourself.
\
THE COl'RT CONVENES AT 12 and sits until 2 p.m Th* n it
recesses a hall-hour for lunch, reconvening at "J:30 to sit until -1
p.m. Mornings, the justices work in their offices.
Because of the Supreme Court's unique continuity, with justice--
serving for life or until they retire, there is far less turnover on
the court's staff than there is in the executive and legislative
branches of the government.
There have been only 1^ reporters who have been in charge of
compiling the court's U4 volumes of decisions.
There have been only U clerks, the 12th—former Dean John T
Fey of George Washington Law School—having taken the position
in 1950.
Until 18f>7 the U.S. Supreme Court used the services of District
of Columbia marshals. But in the past 'JO years there have been
only six marshals seis ing the court.
Similarly, the court has developed its own law librar\ only in
the last 70 years. In this period it has had only loin cio. f hl.iu-
Hans. Present librarian, and tile tlrst woman to serve in that po-t
is Miss Helen Newman.
