tition reciting that Bowman had died
a short time flinco and in effect that
applicant was a brother-in-law of the
deceased, and that the wife of peti-
tioner Mrn. Margaret Reese was the
nearest of kin to Abraham Bowman,
deccuaed; which petition Was duly
granted, and said petition is on file
among the papers of Maid estate in the
County Court of Brazoria County,
Texas, and a certified copy thereof

for partition of the lands belonging to

heirs and distributees of tiie estates
ol' Joseph R and Margaret Reese
were parties defendant; and on or

1849( the Probate Court of Brazoria
Counts entered its decree adjudging In

Bowman At Reese Grant to belong to
the estate of Mrs. Margaret Reese, and

ing that an undivided 1-1 interest in
the land in controversy was owned by
Dewis T Bennett, Caroline C. Bennett,
Catherine E. B.mnitt, Margaret M.
Bennett. Joseph Reese Bennett and
Robert M Bennett, minor children of
Eliza J Bennett, deceased, the daugh-
ter of Joseph and Margaret Reese, and
appointing J C. McNeil, Edmond
Weekley, Abraham Crenshaw, Jarvis
Dockhill and William McMaster, Com-
missioners to make partition and dis-
tribution of said estate, in accordance
witli said decree, and making other or-
ders in the premises, which judgment
is duly recorded in the Probate Min-
nies of Brazoria County, Texas, in
Vol "E" pages 213-217, inclusive, and
(r recorded also In the Deed Records
of Mai tgorda County in Vol. 36 page
550 et seq. Thereafter, on or about
to-wit, Jany. 2, 1850, the Probate
Court of Brazoria County, in said par-
tition proceeding, entered its judg-
ment and decree, dividing the lands of
said estates, whereby, among other
things decreed, the court set aside In
severalty to the heirs of Eliza J. Ben-
nett above named the undivided one-
half of League No. 3, situated on the
West bank of tiie Colorado River in
Matagorda County, granted to Abra-
ham Bownmn and Charles K Reese,

vesting the title of all remaining
heirs of Joseph and Margaret Reese

tom of merchants decorating places
of business for the holiday trade ts a
most hazardous one from u stand-
point of fire. The decorating of
churches und school houses for Christ-
mas trees and other means
tainmeiit is also dangerous,
promiscuous use of fire works
all times a menace to life and prop-
erty.
For the purpose of trying to im-
press upon the public the need for
care throughout the last two weeks
of December, the Department calls
attention to the following important
suggestions contained in the Holiday
Fire Bulletin issued by the National
Fire Protection Association:
Stores, churches and bazaars; Hol-
iday fires in these while filled with
people are usually holocausts,
inflamable decorations make
easy to start and easy to spread
match, a gas flame or an electrical
defect may do It.
Watch, cigar,
smokers Do not permit them
light up” inside buildings. Do not
make tile slightest change in electri-
cal wiring without consulting elec-
trical inspector
Warning for tiie Home: Every
year in America many children are
burned to death by tire from Christ-
mas candles. Do not decorate your
Christmas tree with paper, cotton, or
any other Inflammable material. Use
metallic tinsel and other non-inflam-
mable decorations only, and set the
tree securely so that the children In
reaching for tilings cannot tip it over.
Do not use cotton to represent snow,
if you must have snow use asbestos
fibre.
Do not permit childern to light or
relight candles while patents are not
present They frequently set fire to
their clothing instead; and the tree
itself will burn when needles have
become dry. Do not leave matches
within reaeli of children at holiday
time. Candles are meant to be light-
ed, and If die children can get match-
es they will experiment with them.
They imitate their elders.
A house of merriment is better than
a house of mourning.
These suggestions are conisdered
most timely, and they are offered for
not other purpose titan as an effort
to arouse the public to a point of
alertness that will prevent as far as
is possible, a repetition of fire losses
that have heretofore marked Christ-
mas celebrations.
Every city and town in tiie state
that has not enacted an ordinance
strictly prohibiting the use of fire
work should do so at once.

ceedings being regular On or about,
to-wit, May 6th, 1879, E. G. Thompson
by the Tax Collector of Matagorda
County, Texas, conveyed said land by
tax deed to William C. Braman, by
deed recorded in Vol. "R" page 385-
387, Deed Records of Matagorda
County, Texas. On or about, to-wit,
June 28th, 1879, William C. Braman
conveyed to E. G. Thompson the tux
title so acquired by quit claim deed,
recorded in Deed Records of Matagor-
da County, Vol. R. page 491-192 On
or about, to-wit, June 2, 1879. Ed-
ward G Thompson conveyed by War-
ranty Deed the one-half interest in
the itowman & Reese Grant to D Sul-
livan, said deed being recorded in Vol
"R” page 459-160, De< d Records Mata-
gorda County, Texas, Daniel Sullivan,
tiie grantee in tiie preceding deed, on
or about, to-wit, April 22, 1893, convey-
ed the said one-half interest in the
Bowman & Reese Grant to A II
Pierce by warranty deed, recorded in
Vol. 2 pages 56-58, Deed Records Mat-
agorda County, Texas. A H. Pierce
and Jonathan E Pierce executed a
lived of partition on or about, to-wit.
March 7lh, 1889, by which the whole
of the Bowman Al Reeae Grant was
conveyed and set aside In severalty to
A. H Pierce, siitd deed being reeot ded
in Hook “Y" page 331 of the Deed Re-
cords of Matagorda County, Texas. On
or about, to-wit, November 28th, 1900,
A. II. Pierce conveyed tiie whole of the
Bowman & Reese Grant to W. (’.
Moore by warranty deed recorded in
Vol. 7 pages 438-443, Deed Records
Matagorda County. On or about, to-
wit, December 12th, 1900, W. G Moore
conveyed the whole of tin* Bowman Ai
Reese Grant to tiie Moore-Cortes Ca-
nal Company by deed recorded in Vid.
7 pages 443-1 17, Deed Records of Mat-
agorda County. A. 11, Pierce, deceas-
ed by the executors of Ills will, execut-
ed a release to the Moore-Cortes Ca-
nal Company of the vendor's lien re-
tained In the deed before-mentioned
on August 16th, 1901, same being re-
corded in Vol. 8 page 314 of the Deed
Records of Matagorda County, Texas
The plaintiff Moore-Cortes Canal
Company, In addition to the record ti-
tle, as above set out, to the one-haW
interest In said grant belonging to
tho said Abraham Bowman, has title
by the five and ten years' statues of
limitations to the said land as above
specifically plead.
And plaintiff alleges with respect to
the claim to said nroperty made by
defendants, as follows:
The claim of the defendant Abra-
ham Bowman, and tho heirs of Abra-
ham Bowman, deceased, to tho land
in question Is not known to the plain-
tiff The claim of Eliza J. Bennett, of
Caroline C Bennett, of Robert M. Bet-
nett, of Catherine E. Bennett, of Mar-
garet M. Bennett, and of the heirs of
each of said hist named persons to the
land In question, is not known to the
plaintiff, Moore-Cortes Canal Com-
pany. Tho claim of Rhodes Fisher.
Jr, and the heirs of Rhodes Fisher,
Jr., to the land in question is to an
interest in the claim of certain per-
sons hereinafter named, pretending to
bo heirs of Abraham Bowman, and
conveyed to said Rhodes Fisher, Jr.,
by two powers of attorney, and con-
veyances hereinafter described. The
claim of Cora B. Miller and husband
S. C. Miller, and of J. B. Brookheart
and of the heirs of said respective
persons to the land in question is a
pretended claim asserted by said per-
sons as heirs of Abraham Bowman,
said persons having executed a power
of attorney and conveyance to Rhodes
Fisher, Jr., on April 9th, 1894, record-
ed in Vo! 3 pages 47-48, in tlm office
of County Clerk of Matagorda County,
Texas. The claim of Joseph R. Hicks
and of all the other persons specifi-
cally named as defendants in this writ
(except Rhodes Fisher. Jr., Cora B.
Miller, S. C Miller and J. R. Brook-
hqart land of the heirs of each of said
persons, is to an interest in the land
in controversy under tlm pretended
claim that said persons were heirs of
Abraham Bowman, and that the title
to said land was in Abraham Bowman,
and said claim is disclosed by a power
of attorney and conveyance to Rhodes
Fisher, Jr., dated January, 1894, filed
for record October 22, 1894, and re-
corded In the Records of the County
Clerk of Matagorda County, Texas, in
Vol. 3 pages 48-55; and plaintiff says
that none of said persons pretending
to lie the heirs of Abraham Bowman
were in fact his heirs, and secondly,
that were they his heirs, there was no
title to tho land in controvery either
in Abraham Bowman or in said per-
sons, and there is no title In either
Abraham Bowman or sp.ld persons,
which they qan assert at law or equity
Plaintiff prays Judgment for the ti-
tle and possession of the above de-
scribed land and premises, for writ
of restitution, for its rents, damages
and costs of suit, and for general and
special relief in law and equity.
HEREIN FAIL NOT, but have before
aid Judicial District Court at its
aforesaid next regular term, this writ
with your return thereon, showing
how vou have executed the same.
