Th.- homestead law of Texas has
unquestionably been, without any
fault on the part of the people of this
state, tlie cause of many people de-
clining to make investments here in
the way of loans.
No man who ha* ever discussed
with any Northern or Eastern capi-
talist the question of investing money
in Texas, lias failed to have thi* ex-
perience of having the homestead law
presented as an objection.
Texas people cannot, of course, be
held responsible for the lack of in-
formation, but nevertheless this has
been the cause, or at least the excuse
for refusing to make investments in
Texas,
It may serve a useful purpose to
make-known the truth upon the sub-
ject No homestead claim can ever
be the cause of any investor losing
money in Texas tor the simple rea-
son that no homestead can lie hypoth-
ecated as security in Texas.
Tile republic of Texas was tlie
first government in all history to en-
act a homestead law, which prevent-
ed the home of the family from being
sold for debt, and the law as it exists
deceives nobody.
Any prudent investor of any mate-
rial sum of money will always take
legal advice, and any competent law-
yer will tell him, that if the woud-be
borrower lives on a piece of ground
in a town or city which was worth
less than $5,000, when it was set aside
as a homestead, he cannot give a valid
lien on it in order to borrow money,
it the improvements are worth a mil-
lion dollars, and the furnishings are
us rich as those in Solomon's temple;
nor can that home be seized and sold
for debt.
Any prospective creditor of any
man can easily find out that if the
man dies leaving a homestead worth
any sum of money, however great, it
does not become an asset of his es-
tate so as to be subjected to the pay-
ment of debts.
He can learn, too, that the same ex.
eruption extends to a storehouse in
the same town or city if the owner
has used it for a plaee of business,
provided, the ground on which it
stands and that on which the resi-
dence stands combined, was not. *hen
set apart as a homestead, of value
in excess of $5,000
The investor can learn, too, that it
makes no difference how valuable the
improvements may be on 200 acres in
the country .neither the laud or im-
provements can be taken to pay debts,
nor can he put a lien on it for bor-
rowed money.
This is all very plain and simple
law, and every man is presumed to
know the law It furnishes a sense
of security and comfort to many a
family, and while it sometimes Oper-
ates injustice, and is sometimes used
for purpoaes of fraud, yet some im-
perfection appertains to every human
law. and despite its lack of perfec-
tion the homestead law is Intrenched
in the admiration and affection and
pride of the people of Texas so deepb
that the possibility of change is most
