specially pleads that said proper-
ty is the community property of
himself and his deceased wife,
Willie Rutherford, by virtue of
the same having been purchased
and paid for with community
funds, and in the alternative to
the foregoing plea, specially
pleads that if the same is not
found to be community property,
that certain improvements were
made with community funds of
him and his deceased wife and
that the community estate is en-
titled to be reimbursed therefor.
