Prays That Application For

Granted
An answer was fded yesterday in
county court by Maria Yzaguirre He
Garcia wi<k>w of the late Ovidio
Garcia to an application for guard-
ianship of herself and estate said to
be valued at 1100000 made by he-
sister Gypriana Yzaguirre in Sept-
ember on ground that Mrs. Garcia
was incapable of handling her af-
fairs to tier best interest.
The answer returned through her
attorneys Graham Jones. William
and Ransome prays that the applica-
tion for guardianship be not grant-
ed. It expressly denies that the de-
fendant is or e'er has been of un-
sound mind denies that her sister
Cypriana is her ‘‘next friend” as
set forth in the application and fur-
ther contends that the applicant for
permanent guardianship is herself il-
literate unable to sign her name I
and not competent to manage the af-1
fairs of an estate.
The answer sets forth that th* up-1
pticant is wholly disqualifi* 1 under |
he statutes ai a possible guardian i
even if it were necessary to appoint
one by the fact that she appears as
plaintiff in a suit styled ‘ Maria
Yzaguirre de Garcia by her next

defendant” now pending in district
court without the consent of ami over
>the protest of Maria Garcia.
This action has been taken by Cy-
priana Yzaguirre through her attor-
neys E. H. Goodrich and Son to re-
cover. from control of Macedonio J.
Garcia the estate left to the widow
by the deceased Ovidio Garcia. Pend-
ing judgment in this litigation which
is on the docket of the cofttirg term
of the civil branch of district court
the guardianship application and con-
test therein will be continued in
county court according to the attor-
neys.

behind a buggy standing at the side-
walk opposite the Herald bui'ding
this morning Salvador Rodriguez a
six year old boy was struck by
automobile driven by D. P. Gay one
front wheel passing over his body
before the machine could be stoppe 1.
Injuries apparently were not serious
as shortly after being removed tc a

youngster was able to stand up. No
bones were broken according to j

an ankle.
In describing the accident Mr. Gay j
stated that he was proceeding slow- j
ly but that the boy jumped out from j
behind the vehicle in front of his car
almost under the fender. Attempting
to turn suddenly to avoid striking
him he said one wheel passed over
his right side. No physician was |
summoned and the boy shortly after- |

at every residence and business
building in Brownsville will be in-
augurated immediately throughout
the sections of the city where therg]

ed today by Postmaster R. L. Ginn.
A similar campaign is to be conduct-
ed by the postoffice department ov
er the country on October 19 on
which dry carriers will list every

had by having numbers and recefit
acl.es are outlined by Mr. Ginn as
follows:
House numbers enable carriers to
locate promptly buildings to which
mail is addressed and avoid errors
and delay in delivery.
Mail receptables insure v prompt
and safe delivery of mail in the ab-
sence of occupants.
They avoid delay of mail through
return to the office becauqg of'ab-
sence of occupants or delay in an-
swering the carrier's ring.
They obviate the necessity of pa*

The practice of placing mail in
vestibules under doors on windows
tills etc. where it is exposed to theft
and ihe elements is haxardoat and
frequently results in the loss of high*

j “It is the earnest desire of the
postoffice to accord patrons receiv-
ing mail on the carrier routes the
moet expeditious and efficient serv-
ice possible ” said Mr. Gin “but in
order tb accomplish this It is very es-
sential that all buildings to which
mail is delivered be properly num-
bered and equipped with private mail
receptacles. Without house numbers :
the carriers are delayed in serving!
the routes and erors in delivery un-
avoidably occur especially when sub-
stitutes are on duty.
“To correct this evil the postoffice
department has decided to conduct n
nationwide campaign with a view to
having every building properly num-
bered and equipped with a suitable
receptacle or opening in the door.
Accordingly on the 19th of this j
month every carrier will report the |
address of every dwelling and place
of business on their routes not so
numbered.”

the householder or business suggest-
ing that numbers and mail reeept-
iacles be placed.
The postmaster also has canvassed
the hardware and supply stores to
ascertain their stocks of numbers and
receptacles. He said that some were
without stocks but upon b *ing in-
formed of the approaching campaign
they said they would stock up imme-
diately. The receptacles he said can
be had for about seventy-five cents.

term of criminal court recently tii1-
minntcd left for the state peniten-
tiary on the early train yesterday
to serve sentences rrnging from two
to forty years.
The men are Pablo Perez 40 years
for the alleged murder of Dr. E. S.
McCain; Martin Nava two years
