January. A. 0. 1826. the City of Brawny
ville acting by and through the City At-
torney H. B. Galbraith recovered of and
from the Brownsville Street * Interurban
Railroad Company a judgment in the prin-
cipal sum of Three Thousand Five Hun-
dred and Highly Two Dollars and Sixteen
Cents ($3.5X2.161 with interest thereon at
the rate of six (6) per centum per annum
from date until paid and fur all costs in j

virtue of the terms of a franchise from

railway line was a condition prerequisite
to the maintenance and keeping alive of
said franchise by said railroad company
and
Whereas from and before the date of
said judgment the said railroad company
had totally and utterly abandoned the op-
eration and maintenance of its street rail-
way system had withdrawn it's cars from
service and was no longer engaged in the
business authorised by said city under said
fianehise and the track poles wires and
other equipment of said railroad company
occupying the streets alleys and grounds of
the City are now no longer used for the
purpose for which said franchise was
granted;
Now. therefore be it considered and no
ordered and adjudged and made of record
in the archives of the City of Brownsville
that the said franchise heretofore men-
tioned be and the same is. in all things
voided conceded withdrawn and held for
naught and all the rights duties powers
and privileges exorcised or which could
have been exercised by virtue of said
franchise are hereby declared annulled
voided and terminated and that the City
hy these premises does recover all it's
powers rights and interests in and to the
•<aid property heretofore occupied by said
Company and that said City's obligations
under said franchise are now officially de.
dared ended.
The ahovc and foregoing Resolution being
put to a vote the sumo was unanimously
carried by the Vote of the Mayor and all
the Commissioners present and acting.

Itessie McNear are Defendants and said
petition alleging on or about the 2tth day
of February. A. D. 1926. plaintiff was law-
fully seized and possessed of the following
described land and premises situated in
Cameron County. Texas. holding and
claiming the same in fee simple to-wit:

Clerk’s office of Cameron County. Texas
containing thirty-nine and sixty-nine one
hundredths 139.69) acres of land more or
less.
That on the day and year last aforesaid
defendants unlawfully entered upon said
premises and ejected plaintiff therefrom
and unlawfully withheld from him the
posse?*ion thereof to his damage in the
sum of $1961.60.
That the reasonable annual rental value

Wherefore plaintiff prays judgment of
the court that defendants and each of
them he cited to appear and answer this
petition ami that plaintiff hnve judgment
for the title and possession of said above

writ of restitution issue and for his rents

such other and further relief special and
general in law and in equity that he may
be justly entitled to.
