Colebrook, N. H., Sept. 10.—Harry K. Thaw enjoyed three
hours’ liberty in northern New England today, but was arrested
shortly before noon four or five miles from here by Sheriff Holman

“That Entire Dinner Cost Me Nothing"
When Thaw crossed the interna-
tional boundary at 9 o’clock this morn-
ing at Norton Mills, the first town on
the Vermont side of the border, he
stood for a moment not knowing which
way to go, and then asked one of the
newspaper correspondents who had
followed him from Coaticook in an au-
tomobile if he might enter his car.
Permission was granted, and the par-
ty started immediately for Averill,
where a stop was made.
On reaching Averill Thaw attempted
to ' get in telephone communication
with his mother and his lawyers at
Montreal, but he was unsuccessful.
Re-entering the automobile, Thaw
and his newspaper acquaintances
doubled back into Canada for a short
distance and then returned to Ameri-
can territory through Canaan and
Beecher Falls, Vermont, crossing the
Connecticut river into New Hampshire

Thaw, in an automobile with some newspaper correspondents,
was driving down the road when an automobile containing the
sheriff appeared. The sheriff, recognizing Thaw, held up his hand
for the car to stop. Thaw went into the sheriff’s car without pro-
test, although the officer had’no warrant for his arrest. He was
not locked "up in jail here, but was taken to the office of Tom
Johnson, a local attorney, whom he retained.
During the early part of his flight Thaw lost his hat and wore
a cap borrowed from one of his newspaper companions. His only
possession was a bunch of cigars. From here Sheriff Drew wired
William Travers Jerome to come here to take charge of the fugitive.
Later in the day Thaw will be taken to the county jail at Lancaster.

Sheriff of Coos County Arrests Him in
New Hampshire.

Colebrook, N. H., Sept. 10.—Harry K.
Thaw wandered about the hills of Coos
County, N. H,, for three hcurs today
after being thrust across the Cana-
dian border at Norton Mills and was
arrested by Sheriff Drew of Coos
I County at Little schoolhouse five miles
t from Colebrook just before noon. Thaw
made no resistance and was brought
immediately to Colebrook.
Thaw in his wanderings was accom-
panied only by newspaper men. He did
not know where to go. Leaving Nor-

New York, Sept. 10.—A plan was*
evolved here yesterday for dealing with
the two plays, chief scenes of which
are laid in the underworld, and which
are objectionable to the police. The
plays are to be withdrawn at once.
Within a short time the grand jury
will be conducted to the theaters in
question where the plays will be en-
acted. If sixteen of the twenty-three
members of the grand jury declare the
plays unobjectionable they will be con-
tinued without hindrance. Otherwise*
they will be withdrawn permanently.

mer, reported from Chicago yesterday
as asserting that he had been kidnap-
ped when a child and Who has asked
the Chicago police to search for his
parents is still in this vicinity, it was

Houston, Tex., Sept. 10.—Sheriff
Hammond of Harris county now finds
himself the custodian of two state of-
ficials, both of whom have been denied
bail upon murder charges.
W. C. Stephenson, deputy game war-
den, charged with the murder of T. I.
Monihan at Batson a few weeks ago,
has been refused release at Liberty on
habeas corpus hearing, and is confined,
here. The killing grew out of the ar-
rest ofa party of fishermen, and Ste-
phenson pleads self-defense.
The other prisoner is Bud Russell,
convict guard, who has been refused
bail on a charge of murder growing

1 Waxahachie, Tex., Sept. 10,—Late
figures of losses in the fire and ex-
plosion which destroyed or damaged
several business houses here late last
night are $30,000. Curlin’s pharmacy
and J. B. Hines’ grocery suffered the
heaviest losses. All damage is cov-
ered by insurance. Of the three fire-
men injured William Farrar suffered
most severely, being crushed by a fall-
ing wall.

torney. Thaw then proceeded down the
•road, when he was arrested.
No one was more surprised than
Thaw at his deportation. He was
awakened at Coaticook about 8 o’clock
by immigration officials who told him
they were, going to return him to the
United States. For a moment Thaw
was stunned, then he became excited.
Grabbing a bottle he hurled it at one
of the officers, but the man dodged.
A few moments later Thaw was
dragged out of the building and placed
in an automobile.
“They are kidnapping me,” he
screamed. “They have no right to do
this. They are violating all the prin-
ciples of law. They seem to think ‘to
hell with law.’ They cant take me.
I am to go to Montreal on habeas
corpus.”
A Dominion police officer sat on
either side of Thaw on the rear seat
of the automobile that carried him
td the Vermont line. An immigration
or said in answer to Thaw’s pro-
test: “We are not kidnapping Thaw.
We simply are putting him into Ver-
mont on orders from the minister of
justice.”

National Drainage Congress Plans In-
troducing Rill.

Washington, ept. 10.—The board of
governors of the National Drainage
Congress and a committee on federal
action met here today to prepare for
conferences with Vice President Mar-
shall, Speaker Clark, Secretaries Lane
and Houston and others for the intro-
duction of a $20,000,000 bill for reclam-
ation of swamp lands and flood pre-
vention by the department of the in-
terior. House and senate leaders are
said to favor the measure.

Thaw’s Appeal From Immigration
Board Rejected.

Ottawa, Ont., Sept. 10.—C. J. Doherty,
as acting minister of the interior de-
partment, today said he had rejected
Thaw’s appeal from the decision of the
immigration board of inquiry, uphold-
ing the findings of the board and or-
dering the deportation of Thaw forth-
with. This order was carried out this
morning. The writ of habeas corpus
or writ of prohibition issued at Mon-
treal, said Mr. Doherty, did not enjoin
the immigration authorities from tak-
ing this step.
“I issued the warrant for Thaw’s de-
portation which has been acted upon
this morning,” said Judge Doherty. “I
assume full responsibility for the de-
portation. What was done was merely
to carry out the law.”
Judge Doherty explained that the Ca-
nadian immigration law directed the
seizure of. persons who were suspected
of being undesirable, their examination
by a board of inquiry, and deportation.
“Thaw was suspected, seized, exam-
ined, condemned as an undesirable, and
now has been sent back whence he
came and by the same route,” he added.
“What about the court orders, the
writ of prohibition and the writ of
habeas corpus?” he was asked.
"There was no writ of prohibition
directed to the authorities who had
Thaw in custody. As for the writ of
habeas corpus, it was directed to the
officer who had Thaw in custody be-
fore the board of inquiry took action.
It directed the official to produce Thaw
on Monday. By the operation of the
immigration law Thaw had passed from
the possession of the officer to whom
the writ of habeas corpus had been
directed. He came by operation of the
law into possession of other officials.
There was no court order restraining
them, and nothing to prevent them ex-
ecuting the warrant for deportation.”
“New York asked that Thaw be sent
back to that state instead of to some
other point on the international boun-
dary. Was that point considered be-
fore action was taken?”
“Yes. It was considered and we
found that the law directs that an un-
desirable be deported by the route by
which he entered the country.”
Attorneys here said that Thaw’s
counsel blundered in failing to have
writs directed to the Canadian minis-
ter of justice instead of the minor
officials.
