THE STATE OF TEXAS, To the
Sheriff or any Constable of Galveston
County, Greeting:
Oath therefor having been made as re-
quired by law, you are hereby command-
ed that, by making publication of this
Citation in some newspaper published in
said County once a iweek for four con-

hereof, you summon Lee Thomas,
Defendant, to be and appear before the
District Court, 10th Judicial District, to
be holden in and for the aforesaid
County of Galveston, at the Court House
thereof, in the City of Galveston, at the
next regular term of said Court, to-wit:
on the first Monday in October, 1936,
then and there to answer the petition of
Edythe Thomas, Plaintiff, filed in said
Court on the 18th day of August, 1936,
and numbered on the docket of said
Court 51,964, against the said Lee Thom-
as, Defendant, and alleging, in substance,
as follows :
That plaintiff was lawfully married to
defendant on or about the 29th day of
January, 1933, and that they continued
to live together as husband and wife until
on or about the 4th day of February,
1934, at which time they separated and
since ‘which time they have not lived to-
gether as husband and wife. That there
are no living children as a result of the
marriage of plaintiff and defendant, and
there is no community property belong-
ing to the parties to this suit. Plaintiff
shows to the Court that for a long period
of time defendant pursued a course of
harsh, cruel and unkind treatment to-
wards this plaintiff, in that on many oc-
casions he would abuse this plaintiff, use
vile language toward her and beat and
strike her, causing much bodily pain and
suffering and much physical anguish.
Plaintiff further shows to the Court that
for a long period of time before above set
forth separation, as well as since said
separation, defendant failed and refused
to work and ■ properly support plaintiff
and plaintiff was forced to work and sup-
port herself, much to plaintiff’s embar-
rassment and humiliation. Plaintiff fur-
ther shows to the Court that since the
above set forth date of separation the
whereabouts of defendant has been un-
known to plaintiff and at the present time
plaintiff does not know the whereabouts
of the defendant. That the above men-
tioned cruel treatment is of such a nature
as to render the further living together
of plaintiff and defendant as husband and
wife wholly unbearable and insupport-
able. Wherefore, premises considered,
plaintiff Prays' that defendant be cited by
publication to appear and answer this
petition and that upon a final hearing
hereof she have judgment of divorce
from defendant, for costs of court, and
for such other and further relief, special
and general, in law and in equity, to
which she may be entitled and that plain-
tiff’s former name of Edythe Hencey
be restored, etc., as is more fully set
forth in said petition now on file in my
office.

Sheriff or any Constable of Galveston
County, Greeting:
Oath therefor having been made as re-
quired by law, you are hereby command-
ed that, by making publication of this
Citation in some newspaper published in
said County once a week for four con-
secutive weeks previous to the return
day hereof, you summon Philip Pizzi,
Defendant, to be and appear before the
District Court, 56tih Judicial District, to
be holden in and for the aforesaid
County of Galveston, at the Court House
thereof, in the City of Galveston, at the
next regular term of said Court, to-wit:
on the first Monday in October, 1936,
then and there to answer the petition of
Monica Pizzi, Plaintiff, filed in said
Court on the 13th day of July, 1936, and
numbered on -the docket of said Court
51,867, against the said Philip Pizzi, De-
fendant, alleging, in substance, as fol-
lows :
That plaintiff and defendant were law-
fully married in Victoria, Texas, on or
about the 3rd day of August, 1925, and
continued to live and co-habit together as
man and wife until on or about the 20th
day of November, 1933, when on ac-
count of defendant’s treatment toward
plaintiff, she was compelled to separate
from the defendant and plaintiff has since
said last mentioned date lived separate
and apart from defendant. That through-
out the married life of these parties,
and with but slight interruptions, de-
fendant engaged in a course of cruel,
harsh and outrageous treatment toward
plaintiff. That such conduct on defend-
ant’s part is and Ihas been of such a na-
ture, as to render the further living to-
gether of these parties, unbearable and
insupportable, and in law amounts to
cruel treatment. That there is no issue
of said marriage and no community prop-
erty owned by plaintiff and defendant.
Wherefore, plaintiff prays the Court that
defendant be cited to appear and answer
this petition; that on final hearing here-
of, she have judgment dissolving tht
marriage contract now existing between
plaintiff and-defendant, and that plain
tiff’s- maiden name of Monica Brochet be
restored to her, and for costs, and for
such other and further relief, both in
law and equity, to which she may show
herself justly entitled, etc., as is more
fully set forth in said petition now on
file in my office.
Herein fail not, but have you then
and there, before said Court, this writ
with your return thereon, showing how
you 'have executed the same.
Issued this the 13th day of July, A. D.
1936.
Witness: J. C. GENGLER, Clerk of
the District Court of Galveston County.
Given under my hand and the seal of
said Court, at. office, in Galveston, Tex-
as, this the 13th day of July, A. D. 1936.
