a note in the amount of $880.00
made payable to First State Bank.
Rio Vista, Johnson County, Texas;
and mid bank was named as lien-
holder in the certificate of title, said
certificate evidencing an interest in
the amount of $890.00 owned by
said bank That R. C Bridges
wrecked and damaged mid automo-
bile to the extent $370 00 which
amount R. C. Fuller spent to have
same repaired R C. Bridges aban-
doned the automobile and told R.
C. Fulfer to take charge of same
as he could not pay any more. Geo:
Nelson, a mechanic was repairing
the automobile and the ear was
stolen from his home: and was later
found wrecked and burned near
the Brazos River. The Insurance
Companies refuse to pay for the
lames though the insurance pre-
miums have been paid in full by R.
C. Futer. First State Bank of Rio
Vtsta is a lien-holder Said Insur-
ance Companies were carrying in-
surance on said automobile insur-
ing it against theft and collision.
It C Fulfer prays for judgment
against Hartford Fire Insurance
Co. in the sum of B1290 00 with in-
terests and coats and that said
amount be apportioned as follows:
9970.00 to R C. Fulfer and 9990 00
to First State Bank. Rio Vista.
Texas, and both plaintiffs pray for
such other and further relief spe-
cial and general in law and in
equity, that they my be justly en-
titled to.
The office rexecuting thir pro-
cess shall promptly execute the same
according to law, and make due re-
turn as the law directs.
