Washington.—The Court of Appeals
of the District of Columbia sustained
the regulation of the District Commis-
sioners preventing firemen from en-
gaging in gainful occupation when off
duty.
A member of the fire department
brought suit in 1930 asking for an in-
junction preventing the Commissioners
from enforcing the order. The lower
court granted the injunction. The dis-
trict appealed the decision, and the
appeals court reversed the decree of
the lower court.
The decision said that firemen must
be available in any emergency at all
times, and that the commissioners’ or-
der was undoubtedly valid with regard
to them. It was pointed out, however,
that in certain other districts employ-
ments such as order would be an en-
croachment on the private rights of the
individual and the courts might justly
relieve the situation.

of Texas, which she now here special-
ly pleads and relies upon. Plaintiff fur-
ther represents that by reason of the
facts alleged in Paragraph 2 of this
petition, plaintiff is and was prior to
the institution of this suit and prior to
January 1st, 1930, the lawful owner
and possessor of the premises sued for.
That on the day and year hereinbefore
mentioned, to-wit: January 1st, 1930,
the defendants and each of them un-
lawfully entered upon the hereinabove
described property and premises, and
ejected plaintiff therefrom and unlaw-
fully withholds from plaintiff the pos-
session thereof, to her damage in the
sum of Two Thousand ($2,000.00) Dol-
lars. Plaintiff further alleges that
since the date of the unlawfully entry
and ejection of plaintiff by defendants
hereinabove named, on to-wit: the 1st
day of January, 1930, the City of Gal-
veston, a municipal corporation, caused
to be instituted in the County Court
of Galveston County, Texas, a condem-
nation suit, wherein plaintiff and de-
fendants herein, are named defend-
ants, the same being numbered 14,55 8
on the docket of said County Court,
and by judgment entered on the 23rd
day of June, 1930, the said City of Gal-
veston, deposited in the registry of
said County Court, the entire amount
of damages by the Special Commission-
ers, for account of the benefit of the
lawful owners of said hereinabove de-
scribed property and who may be just-
ly entitled thereto. Wherefore plain-
tiff prays for a decree for the restric-
tion, title and possession of said prop-
erty and premises, as of date, January
1st, 1930; for damages and costs of
suit and for a writ or writs of pos-
session, as many and as often as may
be necessary to place her in possession
of said premises and property; that she
be decreed to be the lawful owner of
the amount of money now deposited
in the registry of the County Court, in
cause No. 14,558, on account of the City
of Galveston having acquired title to
the hereinabove described premises by
virtue of said condemnation suit, and
for all such other and further relief,
both legal and equitable, to which she
may show herself justly entitled, as
is more fully set forth in said peti-
tion now on file in my office.

The State of Texas to the Sheriff or

Greeting:
Oath therefor having been made as
required by law, you are hereby com-

of this citation in some newspaper

Marguerite Custis Sheppard, Defendant,
to be and appear before the District
Court, 56th Judicial District, to be

of Galveston, at the court house there-
of, in the City of Galveston, at the
next' regular term of said court, towit:
on the first Monday in April, 1932, then
and there to answer the petition of
Hardie W. Sheppard, Plaintiff, filed in
said court on the 4th day of March,
1932, and numbered on the docket of
said court 47,969, against the said Mar-
guerite Custis Sheppard, Defendant,
and alleging, in substance, as follows:
That on or about the 25th day of
April, 1926, plaintiff was lawfully mar-
ried to defendant, whose single name
was Marguerite Custis, at Monroe,
Louisiana. That plaintiff and defend-
ant continued to live together as man
and wife until on or about the 15th
day of March, 1929, when by reason of
the cruel, nagging and quarrelsome
deportment of defendant, plaintiff was
forced to leave defendant and since
that time plaintiff and defendant have
not lived together as man and wife.
That during the time plaintiff and de-
fendant lived together as man and
wife plaintiff provided for her support
and did everything possible to make
her contented and happy. That de-
fendant on the other hand quarreled,
nagged and abused plaintiff, and that
numerous times displayed an uncon-
trollable temper. That on the day of
the separation there was another vio-
lent outburst of temper on the part of
defendant, whereby plaintiff was fin-
ally forced to conclude that it was
impossible for plaintiff and defendant
to further retain their relationship of
man and wife. That defendant’s con-
duct and actions toward plaintiff are
of such nature as to render their fur-
ther living together as husband and
wife insupportable, the premises con-
sidered.
Wherefore, plaintiff prays that de-
fendant be cited by publication to ap-
pear and answer herein; and for judg-
ment dissolving said marriage rela-
tions; for costs of suit, and for such
other and further relief, etc., as is
more fully set forth in said petition

further living together became and
was insupportable and unbearable on
account of the cruel treatment of de-
fendant toward plaintiff, and she
separated from him and has not lived
with him since said date. That a short
time after her marriage to defendant
he commenced to drink and come home
under the influence of same, and abuse
her and call her the vilest of names,
and on several occasions struck her
and threatened her with serious bodily
harm, until the further living together
became and was insupportable and un-
bearable, and she left him. That on or
about the 15th day of February, 1926,
he again came home drunk and abused
her and threatened her with a knife
and she became afraid of him and that
he would do her serious bodily harm
and she left him and has not heard

---------------Q.---------------
CITATION No. 48,123.
The State of Texas, to the Sheriff or
any Constable of Galveston County,
Greeting:
Oath therefor having been made as
required by law, you are hereby com-
manded that, by making* publication
of this citation in some newspaper
published in said county once a week
for four consecutive weeks previous to
the return day hereof, you summon
Nora Cleigh Seydler, Defendant, to be
and appear before the District Court,
56th Judicial District, to be holden in
and for the aforesaid County of Gal-
eston, at the court house, thereof, in
the City of Galveston, at thie next reg-
ular term of said court, to-wit: on the
first Monday in June, 1982, then and
there to answer the petition of Arthur
E. Seydler, Plaintiff, filed in said court
on the 11th day of May, 1932, and num-
bered on the docket of said court
48,123, against the said Nora Cleigh
Seydler, Defendant, and alleging, in
substance, as follows:
That plaintiff and defendant were
lawfully married together on Novem-
ber 17, 1926, and are now husband and
wife in law. That the married life of
the parties has been extremely unhap-
py. That the defendant constantly
nagged and fussed with plaintiff over
trivial matters. That on the 20th day
of January, 1932, the parties separated,
defendant declaring that she would not
live in Galveston with plaintiff and
left for California. Plaintiff has tried
on nuemrous occasions to get defend-
ant to come back, but she refuses to
come here and live with him. That
the parties have not lived or cohabited
together since said last named date.
That such conduct on the part of de-
fendant constitutes in law such cruel-
ty as renders the further living to-
gether of the parties wholly impossible
and insupportable.
Wherefore, plaintiff prays that de-
fendant be cited by publication to ap-
pear and answer this suit, and that on
final trial hereof he have judgment
dissolving- the bonds of matrimony,
and for general relief, with costs of
suit, etc., as is more fully set forth
in said petition now on file in my of-
fice.
Herein fail not, but have you then
and there, before said Court, this writ
with your return thereon, showing
how you have executed the same.
Issued this the 11th day of May. A.
D. 1932.
