Walter Shafer expressed
remorse in court Tuesday
shortly before he was sen-
tenced to six years in prison
for failure to stop and render
aid in a crash that killed a
79-year-old man.
Shafer, now 34, was
arrested and charged with
intoxication manslaughter
and failure to stop and ren-
der aid in the death of Julian
Rodriguez on Jan. 12,2012.
Shafer rear-ended a Ford
Ranger pickup in the 700
block of Austin Street just
east of downtown. Rodri-
guez, trying to get inside the
truck, was knocked down
and pinned underneath and
later died from his injuries.
Authorities found Shafer

aggravated assault with a deadly weapon
on Sunday after allegedly attacking two
people.
According to the probable-cause affida-
vit for Richard Earl Martin’s arrest, he told

Broadway and believed him
to be under the influence of
narcotics. He has been out
on bond and has participat-

court.
The failure to stop and
render aid/serious bodily
injury charge is a first-de-
gree felony. As part of
a plea agreement, state
District Judge Ron Rangel
dismissed the intoxication
manslaughter charge.
The one witness to the
crash had since died, a court
official said.

dished a machete during an argument with
his girlfriend of three years and her son” at

The male victim said that Martin, 60, hit
him with a closed fist while holding the
machete, the affidavit shows.
“It was reported that Martin also shoved

of a witness is always “an
issue that has to be taken
into consideration” and that
proving the intoxication
manslaughter case was
made more difficult by other
issues, including a court rul-
ing that “precluded us from
admitting (as evidence)
blood draws that were done
pursuant to the mandatory
blood draw laws.”
“I am very remorseful for
what happened,” Shafer told
Rangel during the sentenc-
ing hearing. “I hit the back
of the truck. I didn’t know
there was someone on the
other side.”
Shafer will have to serve
at least a third of his sen-
tence before he is eligible
for parole.
