The M., K. A T. Sued for Damages
Because of the Separate Coftch Law.
A novel suit has bsen filed in Jus-
tice Cutler's court and one that will
probably bring ebout * decision from
the supreme court on the separate
coach law, the dutiss of the railroad
oompeny in providing for separate s«-
oommodations for negroes and whites
end liability for allowing white and
black passenger to mix on trains of
any company. The style of the salt
D. C. McCaleb and twelve others,
vs. the Missouri, Kansas and Texas
Bailroad Co. The ground for suit is
that the defendant railroad oompeny
allowed a drunken negro to ride pro-
miscuously 00 its passenger farein be-
tweeo Deniaon and Gainesville, and
that the negro rode in the seme coach
with the plaintiffs in the suit, end
tbat by his boisterous and unruly con-1
duct and foul language caused the
plaintiffs muoh annoyance and injury
to their peace of mind, therefore they
aak damagee from the defendant rail
roád company ia the sum of $80 each,
puoitive damages from the said rail-
roed company on account Of thsir
alleged failure to oomply with the
law and allow oolored persons to ride
only in the compartmeat deeigued for

Mr. Gillon -has been traveling in
Eastern Texas since the firat of this
month. He found some lukewarm-
ness among the people, but succeed-
ed in arousing their interest and re-
ports excellent results in ftsry in-
stance. He will remain at home-un-
til next Sunday. After that date he
will devote a month to the work in
GrSyson and Fannin counties.
The reverend gentleman is in ro-
bust health, and speaks pleasantly of
his experiences while absent.

An Ordinance providingfor,
filling of excavations
street and alleys of
Sherman,
Be it ordained by the Oit;
of the City of Sherman :
Section 1. Tbat whenever any
son or corporation shall make
excavation! in the street or alley,
the City uf Sherman for the purpi
of laying, altering or repairing any
gas, water, sewer or other pipes or
mains, or for any other purpose what-
soever, it «hall be the duty of such
persons or corporation to fill such ox-
cavations with such materials and in
•uoh a manner a will restore said
street or alleys to as good condition
as tbey were in before such excavation
was made, and if in the judgment of
the Mayor, the material taken from
such excavation is not suitable for
that purpose, it ahsll be the duty of
theperaon or corporation making such
excavations to provide at their own
expense snob material a the Mayor
may prescribe, and to fill said excava
tlon in such a manner as may in the
judgment of said Mayor be heoessary.
Sec. 2. Any person or corporation
violating any of the provisions of thia
ordinance shall be deemed guilty of
a misdemeanor and upon conviotlon
thereof shall be fined in any sum not
leas than five (15.00) dollars nor more
than twenty-five ($25 00) dollars; pro
vided that each day such excavation
is left unfilled or improperly filled
shall be deemed a separate offense
and a separate fine imposed therefor
Sec 8. That this ordinance shall
take effect and be in force after (SfeJ
