That the acts and conduct as above
recited constitutes in law such cruel
treatment as renders the further liv-
ing together of the parties as husband
and wife wholly impossible and in-
supportable.
Wherefore plaintiff prays that the
defendant be cited to appear and
answer this suit and that on final
hearing that plaintiff have judgement
dissolving the marriage between plain-
tiff and defendant, and for such other
and further relief as the Court think
proper to grant either at law or in
equity, as is further set forth in plain-
tiff’s original petition now on file in
my office.
Herein fail not, but have you then
and there, before said Court, this writ
with return thereon, showing how you
have executed the same.

CITATION No. 56,593
The State of Texas, to the sheriff
or any Constable of Galveston County,
Greeting:
Oath therefor having been made as
required by law, you are hereby com-
manded that, by making publication
of this Citation in some newspaper
published in said County once a week
for four consecutive weeks previous to
the return day hereof, you summon
Johnnie L. Grogan defendant to be and
appear before the District Court, 56th
Judicial District, to be holden in and
for the aforesaid County of Galveston,
at the Court House thereof; in the
City of Galveston, Texas, at the next
regular term of said Court, to-wit: on
the first Monday in October, 1940,
then and there to answer the petition
of Robert Frank Grogan plaintiff filed
in said Court on the 1st day of July
1940 and numbered on the docket of
said Court 56,593 against the said
Johnnie L. Grogan defendant, and al-
leging, in substance, as follows:
That plaintiff is now and has been
an actual bona fide inhabitant of the
State of Texas, for more than twelve
months next preceding the filing of
this suit for divorce and has resided
in Galveston County, Texas for more
that six months next preceding the
filing of this suit for divorce.
That plaintiff and defendant were
duly and legally married in Waco, Tex-
as, on or about the 10th day of Jan-
uary, 1935, and lived and cohabited to-
gether until on or about the 15th day
of April, 1940 and are husband and
wife in law.
That on many occasions, the exact
dates the palintiff is unable to state
with particularity, the defendant was
guilty of excesses, cruel treatment and
outrages, and would strike, curse and
abuse this plaintiff. That particularly
on or about the 15th day of April, 1940
the defendant quarreled with this
plaintiff, cursed and abused and left
this plaintiff.
That as issue of this marriage there
were born to plaintiff and defendant
no children.
