The State of Texas, to the Sheriff
or any Constable of Galveston County,
Greeting:
Oath therefor having been made as
required by law, you are hereby com-
manded that, by making publication
of this Citation in some newspaper
published in said County once a week
for four consecutive weeks previous
to the return day hereof, you summon
John Bondarik to be and appear be-
fore the District Court, 56th Judicial
District, to be holden in and for the
aforesaid County of Galveston, at the
Court House thereof; in the City of
Galveston, Texas, at the next regular
term of said Court, to-wit: on the first
Monday in October 1940, then and
there to answer the petition of Louise
Carroll, a feme sole, plaintiff, filed in
said Court on the 22nd day of March
1938, and numbered on the docket of
said Court 53,837 against the John
Bondarik, Andro Kutzko, Leon Jacob-
son and A. A. Borofsky defendants, and
alleging, in substance, as follows:
That on September 19th 1936, plaint-
iff instituted suit, in District Court, of
Galveston County, Texas, against de-
fendant Andro Kutzko, for breach of
marriage contract and reimbursement
of funds advanced by plaintiff; that
thereafter judgement was rendered in
said suit against defendant, Andro
Kutzko, for sum of $11,348.70 with in-
terest and costs; that execution was
issued and returned nulla bona, and
said judgement is still not satisfied;
that prior to October 10, 1936, defen-
dant Andro Kutzko was owner of
Blocks 319 and 320, in town of Nichol-
stone, now Dickinson, Galveston Coun-
ty, Texas; that defendant Andro
Kutzko having notice of filing of said
suit on the 19th day of September,
1936, did with a view and intent to
hinder, delay and defraud this plain-
tiff, convey to defendant, John Bon-
darik, a non-resident, the above de-
scribed property, for a consideration of
$1500.00, and said deed was filed for
record, and defendant John Bondarik,
took possession of the property; plain-
tiff alleges it to be a fact and the
truth, no consideration passed, and
that said conveyance was a voluntary
one and without consideration, and
made for the sole purpose of hindering,
delaying and defrauding plaintiff, and
that defendant John Bondarik was
fully cognizant of the above facts at
the time he accepted said conveyance;
that the defendant Leon Jacobson and
A. A. Borofsky, are claiming some
right, title and interest in the above
described property by virtue of a deed
of trust executed by the defendant
Andro Kutzko, which claim, if any is
junior and inferior to that of plaintiff’s
and were fully cognizant of the facts
that the original suit was filed, having
appeared as attorneys; that defendant
Andro Kutzko has no other property
in the State of Texas subject to ex-
ecution to satisfy the above mentioned
judgement, unless the property so
fraudulently conveyed can be reached
and applied to the payment of the
judgement in favor of plaintiff against
defendant Andro Kutzko.
Premises considered plaintiff prays
that upon final trial hereof she have
judgement decreeing said conveyance
fraudulent and void against this plain-
tiff; that the recording of same in the
deed records be set aside and for
naught held; that the deed of trust be
adjudged to be invalid and of no force
or effect; that plaintiff’s lien be estab-
lished on the property mentioned
herein and ordered sold and proceeds
applied to ’the payment of the judge-
ment, for costs, etc., as is more fully
set forth in said petition.
Herein fail not, but have you then
and there, before said Court, this writ,
with your return thereon, showing how
you have executed the same.
