Leonard et al vs. Ada H. Edmundson et
al, a certified copy of which decree is of
record in the office of the County Clerk
of Galveston County, Texas, in Book 331,
page 524, et seq, Save and Except the
North 45.83 acres of said 137.50 acre tract
which was set apart in said partition to
Johanna M. Leonard, together with all
improvements thereon.
That plaintiffs would further respect-
fully show that they and those under
whom they claim have and have had
peaceable, continuous and adverse pos-
session of the hereinabove described
property and premises, under title or col-
or of title and plaintiffs still have full
title to the property sued for, precluding
all claims of defendants.
That plaintiffs would further represent
that for more than five years preceding
and prior to the institution of this suit
plaintiffs and those under whom they
claim have had peaceable, adverse and
continuous possession thereof, cultivating,
using and enjoying same and paying-
taxes thereon, and claiming under deeds
duly registered within the meaning of the
Statutes of Limitation of the State of
Texas, and plaintiffs still have full title
to the property sued for, precluding all
claims of defendants.
That for more than ten years preceding
and prior to the institution of this suit
plaintiffs and those under whom they
claim have had peaceable, adverse pos-
session of the property involved in this
cause, using, cultivating and enjoying
same within the meaning of the Statutes
of Limitation of the State of Texas, and
plaintiffs still have full title to the prop-
erty sued for, precluding all claims of de-
fendants.
That for more than twenty-five • years
preceding and prior to the institution of
this suit plaintiffs and those under whom
they claim have had peaceable, adverse
and continuous possession of the property
involved in this cause under deeds duly
registered and under a regular chain of
title, and plaintiffs still have full title to
the property sued for precluding all
claims of defendants.
That by reason of the facts alleged
herein, these plaintiffs are and were prior
to the institution of this cause of action
the lawful owners and possessors of the
premises sued for herein.
That on the day and year hereinabove
mentioned, the defendants and each of
them, unlawfully entered upon the here-
inabove described property and premises
and ejected plaintiffs therefrom and un-
lawfully withhold from plaintiffs the pos-
session thereof, to their damage in the
sum of 51,000.00.
That the reasonable annual rental of
such property is the sum of 510.00.
Wherefore plaintiffs pray for a decree
for the restitution, title and possession of
said property and premises, and for dam-
ages, rents and costs of suit, that all of
said defendants be cited as required by
law, and for a writ or writs of possession
as many and as often as may be neces-
sary, and for all such other and further
relief, both legal and equitable, to which
they may show themselves entitled, etc.,
as is more fully set forth in the petition
now on file in my office.
If this Citation is not served within 90
days after the date of its issuance, it
shall be returned unserved.
