representatives of the said Mrs. W. M.
Stafford, and their heirs and/or legal rep-
resentatives; Port Bolivar Development
Company, a defunct corporation, and the
unknown stockholders and officers of said
Port Bolivar Development Company, and/
or their legal representatives; The Com-
monwealth Trust Company of St. Louis,
Missouri, a corporation, together with all
unknown owners and/or claimants, as de-
fendants.
The nature of said suit being substan-
tially as follows to-wit: A suit in tres-
pass to try title to recover title to and
possession of the following described
tracts or parcels of land:
Lots Nos. One (1) to Ten (10) inclu-
sive, Lots Nos. Thirteen (13) to Twen-
ty-four (24) inclusive,, in Block 141, of
the town of Port Bolivar, Galveston
County, Texas, as shown by the map
or plat of the town of Port Bolivar re-
corded in Vol. 113, page 1, of the Deed
Records of Galveston County, Texas
and for damages.
Plaintiff’s petition says that she has
held open, notorious, peaceable, contin-
uous and adverse possession of said above
described land and premises, using and
enjoying the same for more than ten
years after any cause of action that the
defendants, and/or each of them, might
have had accrued and before the com-
mencement of this suit that by reason of
such possession of the plaintiff, she has
and holds a fee simple merchantable title
to said tracts of land and here pleads the
ten years statute of limitation of the
State of Texas to establish her title as to
the above described tracts of land.
Plaintiff prays that the cloud cast upon
plaintiff s title by the right, title or in-
terest and claim in and to said premises
asserted by the defendants, and by each
o.them, be.removed by proper decree;
that, the plaintiff have her writ of pos-
session and her damages, for costs of
suit,and for general relief, as is more

You are commanded to appear and an-
swer the plaintiff’s petition at or before
10 o’clock A. M. of the first Monday
after the expiration of 42 days from the
date of issuance of this Citation, the
same being Monday, the 8th day of July,
A. D., 1946, at or before 10 o’clock A. M.,
before the Honorable District Court of
Galveston County, at the Court House
in Galveston, Texas.
Said plaintiff’s petition was filed on the
23rd day of May, 1946. The file number
of said suit being No. 67,643.
The names of the parties in said suit
are: Rene Muller, Jr., as plaintiff, and
H. E. Scott and wife, Johana E. Scott, if
living, and if either or both the said H.
E. Scott and wife, Johana E. Scott, are
dead, then the heirs, executors, adminis-
trators, and legal representatives of the
said H. E. Scott and wife, Johana E.
Scott, and/or either of them, as Defen-
dants.
The nature of said suit being substan-
tially as follows, to-wit: That plaintiff
is a bona fide inhabitant of the State of
Texas, and actually resides in Galveston
County, where this suit is filed. That the
defendants, H. E. Scott, and wife, Jo-
hana E. Scott, if living, are each and all
respectively non-residents of the State
of Texas, and in the alternative plain-
tiff alleges that the residences of each
and all of the said named defendants, H.
E. Scott and wife, Johana E. Scott, if
living, and if dead, the heirs, executors,
administrators, and legal representatives
of the said H. E. Scott and wife, Johana
E. Scott,' are unknown to plaintiff, and
upon each and all of whom citation may
and should be issued for service by pub-
lication, according to law.
That on the 21st day of May, 1946,
plaintiff was, and still is, the owner in
fee simple of the following described
land, property and premises situated in
the County of Galveston, Texas: All of
Lot No. 18 of Fountainbleau Subdivision
in the J. C. Stephens, and sometimes
known as Stevens, and A. Burke Sur-
veys, near the town of Hitchcock in Gal-
veston County, Texas, according to the
map or plat of said Fountainbleau Sub-
division appearing of record in Volume
119, Page 27, of the Deed Records in the
office of the County Clerk of Galveston
County, Texas, together with all im-
provements thereon located.
That on such day, also, plaintiff was in
possession of such premises, and after-
wards, on or about the 22nd day of May,
1946, the defendants and each of them,
jointly and severally, unlawfully at-
tempted to enter upon said premises and
to dispossess plaintiff of such premises
and to withhold from plaintiff the pos-
session thereof.
That plaintiff has had and held peace-
able, continuous and adverse possession,
under title and color of title, from and
under the State of Texas, of the lands
and tenements hereinabove described and
claimed in plaintiff’s petition, for more
than three years after defendant’s cause
of action, if any they ever had, accrued,
and before the commencement of this
suit.
That plaintiff and those whose title he
holds, have, claiming the same under
certain deeds duly registered and appear-
ing of record, had peaceable, continuous,
and adverse possession of the lands and
tenements hereinabove described and
claimed by plaintiff, cultivating, using
and enjoying the same, and having the
same completely enclosed under fence,
and paying all taxes as same became due
thereon, for a period of more than five
years after the defendant’s alleged cause
of action, if any they ever had, accrued,
and before the commencement of this
suit.
That plaintiff and those under whom
he claims, have had peaceable, continu-
ous, notorious and adverse possession of
all of the above described lands and tene-
ments located and being situated in Gal-
veston County, Texas, cultivating, using,
enjoying and grazing the same, complete-
ly enclosed and under fence, for more
than ten years next preceding the 22nd
day of May, 1946, and for more than ten
years before the date of filing of this
suit, and for more than ten years after
any cause of action accrued against this
plaintiff and/or his predecessors in title
in favor of each and all of the herein-
above named defendants, respectively,
and/or their respective predecessors in
record title for title and possession of
such described land and tenements, plain-
tiff having enclosed and fenced such de-
scribed land previous to the year 1925,
and during all of the period of time since
the fencing and enclosing of said land
as aforesaid, and for more than ten years
subsequent to such date of fencing and
next preceding the filing of this suit,
this plaintiff has had such lands and
tenements actually enclosed, notoriously
and openly using, claiming, and enjoying
the same under the ten year statute of
limitation.
That the alleged asserted claims and
the threats and attempts of the defen-
dants, respectively, jointly and severally,
to enter upon the said described land,
cast a cloud, and an apparent cloud, upon
plaintiff’s title to such described land
and premises.

and premises described, claiming the
same under muniments of title specifying
the boundries thereof and including and
comprehending said property involved
herein, for a period of more than 10
years prior to the commencement of this
suit.
Plaintiff further says that he ought to
have and recover of and from said de-
fendants, and each of them, title to and
possesion of said land and premises, be-
cause he and those whose title he holds
have had and held peaceable continuous
and adverse possession of the property
and premises described, title to which
passed out of the State and Republic of
Texas, and using and enjoying the same
in good faith under deeds and muniments
of title duly had and duly recorded, con-
stituted a regular chain of title for a
period of more than 25 years prior to the
commencement of this suit.
Wherefore, plaintiff prays that the de-
fendants be cited to appear and answer
in this behalf, and that upon final hear-
ing hereof, plaintiff have and recover of
and from each and all of said defendants,
title to and possession of the herein de-
scribed land and premises, and that he
have his writ of possession, damages,
costs of suit, etc., as is more fully set
forth in said original petition now on file
in my office.
If this Citation is not served within 90
days after the date of its issuance, it
