sioner for the North Texan district
appeared before Judge Edward R
Meek or the circuit and district court
this morning - and formally qualified
to that office. Mr. May took Immediate*
possesson of the office, holding a
short term of court and discharging
a number of cases.
Mr. Mny has resided in Dallas for
the past eighteen years. He haa lived
in Texas for thirty-six years. He is a
member of the “old guard" of the Dal-
las county Republican party and has
presided over several county conven-
tions.
Upon assuming the duties of United
Staes commissiner this morning Mr
May at once took up the ease of C. J
Davis, charged with forging a material
algnature to a five dollar money order
made payable to Earl Wright. Davis
pleaded gulltv and was held to await
the January term of court.

Dallas, May 19.— (Special.)—An un-
known white man, apparently about 5*
or 60 years old, was brought to the
eity hall this afternoon on one of the
Interurban express cars. In an uncon-
selous condition. The man was res-
cued from Trinity river near where
the Interurban crosses the river. It is
believed he fell from the treetie while
crossing the river.
He hud evidently been in the water
for some time whn he was taken out
by men who happened to be passing.
When brought to police headquarters
ho was in much pain. Besides the
large quantity of water which the man
had swallowed, he was considerably
bruised about the right shoulder and
two or throe ribs were broken.
* The man was removed to the city
hospital.
From appearances the man was a
carpenter or mechanic of some kind,
and a little book found on hie person
showed that he had recently purchased
some hardware from the Huey A Philp

Dallas, May It. — (Bpeclal.) — The
Southwestern conservatory is the name
of another musical institute which is
soon to be established in Dallas and
which was incorporated last week. It
is raid by the promoters of this new
enterprise, who are among some of the
best business men of Dallas, that ths
new conseryatory will be conducted on
the highest possible plane and that
some of the best talent in the country
will be employed in the faculty of the
insiitution
The officers of this institution are:
W. T. Fakes, president; J. W. Everman,
vl.e president, W H. Wray, vice presi-
dent; Rhodes 8. Baker, secretary, and
Ge orge W. Riddle, treasurer.
The bard of directors consists of W,
T. Fakes John W. Everman, J. K Gil-
bert, Dr. F. J. Dickey, Rhodes B. Baker,
W. H. Wray, J. W. Slaughter, George
W. Riddle and Epps G. Knight.
There are about sixty-five other

McKinney Texas. May 19.—(Special.)
The Injunction suit brought by J. Per-
ry Burrus and J. P. Crouch of this city,
to restrain the city of McKinney from
extending ‘the city electric light sys-
tem for the purpos j of furnishing elec-
tric lights to citizens, came up for
hearing on motion to dissolve the In-
junction before Judge B. L Jones of
Sherman, in this city yesterday the
hearing not being completed until last
night.
The original plaintiffs bring their
suit to restrain the city from furnish-
ing lights to private individuals for
pay, claiming that the elty did nt have
the right to engage in commercial
lighting, and that the city had no
power to borrow and use money from
other funds in its hands, such as water
rentals, until said system of lighting
shall become self »ustaining; that the
electric light bonds were issued for
the purpose of lighting the . streets
only, alleging discrimination In water
rates and the use of the waterworks
plant to enable the city to furnish elec-
tric lights below the cost of produc-
tion.
The McKinney Electric Licht A Mo-
tor Power compary file a plea of in-
tervention. in which they join with
pleintiffs against the city, and set
iorth that they hold a franchise
granted by the city for furnishing
lights, that they have Invested large
•ums of money in an electric light
plant, and that the rate attempted to be
made by the city is below the cost
of production of tne electricity and
amounts to confiscation of their prop-
erty.
The Injunction proceedings were
among the most ‘mportant over held
in McKinney and intense interest was
manifested, a large number of citizens
being present at the courthouse during
the entire hearing The city was rep-
resented by City Attorney I. E Reeves,
Abernathy and Mangum, and'Church A
,. Doyle and the. applicants were repre-
sented by Abernathy A Abernathy. Hon.
M. H. Garnett and Hon. G. R. Smith.

sides, continuing until after supper

Dallas, May IL— (Bpeclal.)— At ths
last session of ths legfalature a meas-
ure known as the depository law was
passed. Thia law provides that all
funds shall be deposited in the bank
making the highest bids for the de-
posits in all counties whsrs there is a
city of 25,000 or mors in population.
The carrying out of this law practically
does away with the office of ounty
treasurer and it is left optional with
the county commissioners' court as to
whether the office shall be abolished.
Recently, in Travis county, the com-
misaloners' court voted to abolish the
office of county treasurer, making the
bank that bid for the county funds
the agent for the handling of tho coun-
ty’s funds.
County Commissioner W H. Pippin
has drawn up a resolution which is
soon to be presented to the Dallas com-
missioners’ court fixing the commis-
sions of the county treasurer.
It is pointed out by Commissioner
Pippin that the county will be saved
$2,000 a year by this action. The com-
missioners court has the right to fix
the compensation which the treasurer
shall receive for reelvimg and dis-
bursing the county funds, outside of
school funds.
The board of county commissioners
seems to favor ths passing of the reso-
lution, and it is believed that when it
is brought up that the vote will be
unanimous
The resolution as drawn by Mr. Pip-
pin, and which ia to be presented at
the first session of the court. Is as
follows:
“By the authority vested in the com-
missioners’ court under article 24*7 of
the revised statutes of the state of
Texas, it is hereby ordered that the
commissions of the county treasurer of
Dallas county for receiving and disburs-
ing all funds be fixed at .... per an-
num from and after the exportation of
