“The law is clear,” Attorney
.General James V. Allred has
advised K. C. Barkley, Harris
County, District Attorney, to-
day, answering Barkley’s - in-
quiry about 8.2 beer sales.
The Attorney General point-
ed out that unless and until
the new State law takes effect,
sale of beverages with over 1
per cent alcholic content is
punishable. Issuance of Federal
- permit does not affect the
status, the Attorney General
ruled.
If grand juries will not indict
Allred calls the Houston At-
torney’s notice to the injunc-
tion statute under which sales
places becomes nuisances and
may bo closed for a year.
Regarding Federal permits,
Allred said:
“In my judgment, the issu-
ance of these permits has done
much to confuse the minds of
Texas citizens concerning the
status of the State liquor laws.
I can not too strongly condemn
such a policy, for it is lending
encouragement to open and
flagrant yiolations of the laws
of a sovereign -State. While I
doubt the authority of these
agents of the Federal Govern-
ment to issue such permits at
this time, even if such au-
thority .be conceded, in my
judgment, the action is viola-
tive of the very spirit of the
act of the National Congress,
which seeks to .preserve . the
integrity of dry-territory until
its laws have been regularly
changed.”
