Washington, Oct. 29.—The United
States supreme court has granted
the request of the Hitchman Coai
and Coke Company of West Virginia
for a review of the decision made by
the federal court of appeals, sitting
in Richmond, Va., last May, when
Judge Dayton’s injunction against
officers of the United Mine Workers
was set aside.
Judge Day ton issued this injunc-
tion in 1907 against John Mitchell
and W. B. Wilson, then officers of
the United Mine Workers, and all
others, who were enjoined, among
other things, from attempting to
unionize the Hitchman employes
with the plaintiff’s consent.”
The court of appeals reversed this
order and held:
"It should be understood once and
for all that as long as capital em-
ploys legitimate means for the pro-
tection of property rights, that it is
to be accorded the protection of the
law; but this does not mean that
capital may, by improper methods,
form combinations for the purpose
of preventing labor from oragnizing
for mutual protection.”
The company appealed from this
decision and insisted that the ques-
tions involved are of such import-
ance to capital and labor that the
court of last resort should review the
case.

A “Ned Sedgwick” testimonial
benefit will be given at the Crystal
Majestic Theater on next Friday
night, Nov. 6, when Galveston’s best
local talent will assist the Princess
Stock Company in the program for
the evening. Thus will the man that
has during his life here managed
and staged hundreds of benefits for
others himself become the recipient
of a benefit.
Ned Sedgwick, who was all but
born here and has spent forty years
in Galveston, is too well known to
need mention when talking to Gal-
vestonians. Scores and scores or
times during his life he has given
great amounts of time and attention
to benefits for local institutions and
individuals, invariably making of
them a success and refusing compen-
sation for his work. Perhaps one of
the best known benefits he staged
here was “America” for the Busi-
ness League shortly after the 1900
storm, the benefit being a great suc-
cess in every way.
Mr. Sedgwick now has two daugh-
ters and one son with the Hotex
Film Company, they having former-
ly been with the Lubin Company.
At various times during his life
here Mr. Sedgwick has been con-
nected with the police and sheriff
departments, engaged in cotton
work and affiliated with local
unions.
Program for the benefit has not
been completed. It will be given in
full next week.

With the addition of several new
contestants in Houston, Beaumont
and Port Arthur, the great circula-
tion contest takes on new life and
energy. District 3 now has a nice
quota of workers, and with all of
them extremely busy, there are some
interesting developments just
ahead. Also, the Galveston workers
are keeping up their activity in a
very gratifying manner, and it is ab-
solutely certain that enough votes
will be turned in during the next
few weeks to change a presidential
election, were they to be that kind
of votes.
