In affirming the case of Sidney
Haber vs. R. W. McClain, District Clerk,
from McLennan County, the Third
Court of Civil Appeals held in effect
today that a juror is not entitled to
pay when excused by the court and is
not in physical attendance on its ses-
sions, even though he han been sum-
moned for the week and was impaneled
before the absence. Haber was legally
summoned and impaneled on Munday
and was excused until Wednesday. The
clerk refused to pay him the fee for
Tuesday, the day he was absent. Man-
damus proceedings were instituted to
compel the clerk to pay the fee, the
trial court denied the petition and this
is sustained by the court today.
