to order by the speaker. Roll call
showed quorum present. Prayer by the
chaplain.
Following members were excused for
the day on account of Important busi-
ness; Messrs. Relger, Bennett, Napier.
Eawards, Meacham, Wooten and
Marsh.
The chair laid before the house as
the pending business the Terrell elec-
tion bill with amendments.
Mr. Brown withdrew' the substitute
for the amendment prohibiting the
payment of poll tax by proxy.
.Mr. Mulkey asked and obtained
unanimous consent to call up and have
passed house bill No. 283, relating to
service by citation in suits against In-
corporations and joint stock compa-
nies. Roll call and bill passed finally
by a vote of 103 to 0.
.Messrs Terrell and Love offered an
ameudment. providing tht in cities of
1.000 inhabitants other than the coun-
ty site. It shall be the duty of the col-
lector to have a duly suthorized dep-
uty to represent him for the purpose
of accepting payment of poll tax, and
who shall keep an omice for this pur-
pose during the month of January of
each year. Amendment adopted.
Mr. Love offered an amendment
merely correcting the language of the
pill, and striking out superfluous ver-
biage.

Resuming consideration of the elec-
tion bill. Mr. Love offered a substitute
for the amendment to the amendment
to the bill, "providing the voter re-
irides in a city of 10,000 inhabitants, he
shall not be allowed to pay the tax by
proxy; if in a town of less, he may
have an agent to pay the kamne. the as-
seusor noting on the receipt that the
tax was paid by an agent.
Mr. Bridgers opposed the substitute
for the reason that It would disfran-
chise thousands of honest voters.
Mr. Terrell favored the substitute,
saying it was a compromise measure
and agreed to by the friends of the
bill. "Every man in this house can not

The substitute was adopted by a
vote of 54 to 86.
The Harbison bill defining a quali-
fied voter and which seeks to perfect
the poll tax constitutional amendment
came up as pending business. The
bill came up with an amendment pro-
viding that a voter must pay his poll
tax in person and a substitute for the
amendment that the poll tax can be
paid by another when requested to do
so and refund the money before the
next general election. Senators Wil-
lacy and Douglass favored the substi-
tute for the amendment. Senator Har-
bison was discussing the bill when the
senate adjourned until next Tuesday
morning with the bill and amendments
pending
vote of 68 to 33, which shows that the
bill will finally pass that body. So
much disfigured has been the bill dur-
ing its consideration that the author
himself hardly recognizes it. So that
the lawmakers may have an Idea of
how the bill now is. Judge'Terrell se-
cured the consent ofithe house to have
200 copies of the bill as amended and
.engrossed printed /or the benefit of
the members. Thismeasur consumed
the greater part of at least two days
of the session. Most of yesterday’s ses-
sion was taken up with Its consider-
ation. The amendmept over which
there was the most debate was one
Senator Hicks introduced a joint
resolution instructing the commission-
!r.. the general land office to with-
hold from sale certain public lands
pending the passage of a blil now
pending to fix the method of filing ap-
plications by actual settler*;.
The senate was advised that the
house had refused to concur in the
senate amendments to the Houston
charter bill and asked for a conference
committee. The chair appointed Sen-
ators Lipscomb. Mills, Faubion, Hang-
er and Stafford on the part of the
senate.

The colored citizens of Texas are
apparently receiving much attention at
the hands of the present legislature.
Thursday a bill .was introduced in the
senate providing for the establishment
of a home for the colored indigents of
the state and ysterday a similar
measure was introduced in the house.
•The bills carry an appropriation of
125.000 to carry the act Into effect.
The senate yesterday finally passed
a bill to give the railroad commission
additional space in which to hold its
hearings. The bill originally contem-
plated giving the commission three
more rooms, but the senate could not
see it that way, and as passed the
bill simply gives the commission an
open space near the offices now occu-
pied by it and which was originally
intended for joint postofices of the
house and senate, and have this sphce
enclosed for the use of the commission.
