this be true it shows a total lack
of ability on the part of the Yale
authorities to comprehend the
Southern sentiment on the subject
to say nothing of their lack of cour-
age tostand by their convictions.
True there are some Southernwhite
men who might be uarrow enough
to object even to such an honor
beiDg bestowed upon a colored man
cs that which was contemplated by
Yale but it is also true beyond
doubt that the great majority of
thinking Sonthrons would have
considered it only a just recogni-
tion of iperit. Booker Washington
has received full honor throughout
the South as a man of the highest
ability an educated refined negro
who stands as a leader of his race.
It has been suggested by the Gal-
veston Tribune that some Southern
college or university should bestow
upon him Ihe honor which Yale
has backed courage to give in or-
der to prove that the South does
reeoguize the real merit of Prof.
Washington's achievements. The
suggestion is a good one and should
hf-i carried out.

Court PUBLIC NOTICE is hereby giv-
en to all persons claiming certain goods
wares and merchandise to wit: Twenty-nine
sacks of shelled corn one hun-
dred and forty-six barrels of corn in the
ear and oue Mexican saddle and blanket
therefore seized within said District for
reasons and causes mentioned in a cer-
tain information in rem filed in said
cause in said Court; said goods wares
and merchandise so seized as aforesaid
.having been by me attached in the cus
tody of C. H. Maris. Esquire Collector
of Customs for the Port and District of
Brazos de Santiago and now detained
in his custody within the judicial and
collection districts aforesaid by order of
the said Court; and to all persons know-
ing or having anything to say why the j

said goods wares and merchandise for
the forfeiture and condemnation of the
same according to the prayer of the
said information and that they be and
appear before the said Court to
holden in and . for said District at
Brownsville Texas on the first Mon-
day in January next if that be a day of
jurisdiction if not then on the first day
of jurisdiction thereafter at 10 o'clock
in the forenoon of that day the same
being the return day of said writ and
the day of the trial of said seizure and
information and then and there to in-
terpose a claim to the said goods wares
aud merchandise and to make their al-
legations in that behalf.
The said seizure and forfeiture being
in substance for the following- reasons
to-wit:
1. The said goods wares and iner-
chandiso were on to-wit: On the sev-
enth day of August A. D. 1901 unlaw-
fully brought into the United States
from the Republic of Mexico by some
person or persous unknown at some
place as yet unknown that is to say :
Without entry declaration or pay-
ment or accounting for the duties on the
same to the said Collector of Customs
for said Collection District.-
2. That the said goods wares and
merchandise being subject to duty by
law and which should have been in-
voiced on to-wit: The seventh day of
August A. D. 1901 were unlawfully
wilfully and with intent to defraud the
revenues of the United States smuggled
and clandestinely introduced into the
United States from the Kepublic of
Mexico by some person or persons un-
known at some place as yet unknown
without paying or accounting for the
duties on the same.
The said order of Court of October
9th A. D. 1901 herein-before mention-
ed is as follows to-wit:

October 9 1901.
It is ordered by the Court that the
above entitled cause be set for hearing
at the United States District Court-room
at Brownsville Texas on the first Mon-
day in January next if that be a day of
jurisdiction if not then on the first day
of jurisdiction theieafter.
It is further ordered by the Court
that the Marshal of the District give
fourteen days notice of the seizure of
fjaid goods wares and merchandise and
information in rem by causing the sub-
stance of said information and this or-
der to be published in the newspaper
known as The Daily Herald publish-
ed at Brownsville Cameron County
Texas and by posting in the most pub
lic manner notice thereof for the space
of fourteen days in the City of Browns-
ville Texas to-wit: On the public bul-
board in the Postoffice Building in
said City;
Aud that the Marshal make due re-
return of his action in the premises;
It is further ordered that the Clerk of
the Court at Brownsville Texas file
and record this order in the minutes of
this Court at Brownsville.
Done and ordered at Chambers at El
Paso Texas this 9th'. day of October
