The Sunday school rally and first
annual convention of the Fifth pre-
cinct of Austin, held yesterday at the
Cumberland Presbyterian church, was
largely attended and. proved a very
successful event. Marshall W. Hudson
of Syracuse, N. Y., the founder of the
Baraca movement, and W. N. Wiggin
of San Antonio, state superintendent
of the Sunday school association, con-
tributed much to the meeting. Rev.
Dr. Josephus Johnson, pastor of the
Southern Presbyterian church, con-
ducted devotional services, after which
an elementary round table was con-
ducted by W. N. Wiggin. Mrs. God-
bey, wife of the Rev. Dr. Godbey who
has been assigned to the pastorate of
the Tenth Street Presbyterian church,
who was to have assisted in this
round table, was unable to be present.
The program throughout the day was
carried out according to program as
published in The' Statesman last Sun-
day morning.
At night a reception was tendered
to Mr. Hudson at the First Baptist
church by the Baraca-Phllathe a
classes of Austin, which proved most
enjoyable. Mr. Hudson made an ad-
dress on 'The . Baraea-Philathea
Classes, What They Are and What
They Do.” A short talk was also made
by Rev. Dr. Luther Little, after which
a social time was enjoyed and re-
freshments were served. The day was
one long to be' remembered by the
large number of people who par.

The Austin High School and Coronal
Academy will play this- afternoon at
2 o clock on Clark Field and an in-
teresting game is promised. The high
school, has won a number of games
this xar and is able to give any team
of itsi class a stiff game. Coronal has
also done well this season dnd if she

hard struggle. The game will be full

day of January and the first day of
July, obtain a nw permit to pursue
his respective business or calling, and
any person, firm or corporation pur-
suing such business or calling, as pro-
vided for in this ordinance. without
first obtaining the permit as required
by this ordinanc, shall be deemed
guilty of a misdemeanor and, upon
conviction In the corporation court of
the city of Austin, shall be fined not
less than $5 nor more than 8200. and
that each and every day that such per-
son. Ann or corporation pursues such
avocation or calling without a permit
shall be a separate and distinct of-
fense. " .
See. 11. That for the purpose of car-
rying out this ordinance, the city of
Austin shall appoint a pure food in-
spector. Bald Inspector shall be a
graduate of a recognised veterinary
college, shall be nominated by the
board of health, and his nomination
and appointment shall be ratified by
the mayor and city council, provided,
however, that the mayor and city
council shall not have any right to
elect or appoint any person to this
position who is not first recommended
by a majority of the board of health
of the city of Austin.
Bec, 12. The Inspector shall make
an inspection of all dairies within five
miles of the corporate limits of the city
of Austin as. often as directed by the
board of health and not less than once
each three months.

forfeit his or her permit as the case
may be and shall not for the term of
six months be granted a permit to en-
gage in business of like kind and char-
acter within the city limits of the city
of Austin.
See. 19. That all rules and regula-
tions and fees proposed and promul-
gated by the board of health shall first
be subject to confirmation by the city
council before becoming effective.
Sec. 20. Any persons, firm or cor-
poration violating any of the provisions
of this ordinance shall be deemed
guilty of a misdemeanor and, upon
conviction, shiall be fined In any sum
not less an $5 nor more than 8200.

shall be accompanied by a reasonable

Before Judge John W. Hornsby in
thq county court two men, Will Mc-
Bride, charged with emnbezzlement,
and Crescentio Reyes, charged with
carrying a pstol, were tried by juries
and both found not guilty. The jury
which heard th evidence in the
case of he state against Edward
Ebelt charged with carrying a pistol,
which had been out sirfe Monday nf-
ternooD, reported to the court that
they were unable to agree and were
discharged, It is understood that the
jury stood 5 to 1 for acquittal.
The defendant Reyes Who was ac-
quitted yesterday of the charge of car-
rying a pistol, had been in jail elghty-
seven days awating his trial, so that
even if he had been guilty he would
have served a good long sentence. Un-
der the old law the justice of the peace
had concurrent jurisdiction with the
county court in the pistol toting cases
and usually the accused were tried in
a few days after being arrested, but
the Thirtieth legislature increased the
penalty to such an extent that all the
cases must go to the county court and
when a defendant is not ready to plead

Section 1. Be It ordained by the
city council of the city of Austin, that
the board of health of the city of Aus-
tin, heretofore appointed as provided
by ordinance, shall have the power and
it ds hereby given the power to pro-
vide and promulgate and publish such
rules and regulations providing for the
proper keeping, production, barter and
sale 'of food stuffs sold and offered for
sale within the corporate limits of the
city of Austin, as to them may seem
for the best interest of the public
health of the city of Austin.
Sec. 2. That by the term "Food
Stuffs,” as used in section 1 hereof, is
meant any and all products usually
consumed by human beings, either in
the original state or used as ingredients
mixed with other products, and in or-
der that there shall be no uncertainty
for the purpose of this ordinance, the
following shall be considered food
stuffs: All kinds and classes of meats
offered for sale by markets or grocery
stores, all kinds of vegetables and
fruits raised for human consumption,
all kinds or classes of dairy products,
