PENROSE ACQUITTED..
After seven weeks' sitting and
the hearing of testimony from sev-
eral scores of witnesses the court-
martial which was supposed to be
trying Major Charles W. Penrose
for neglect of duty on account of
the outrage committed by the sol-
diers of his command against
Brownsville on the night of Aug.
13 last devoted four hours (pre-
sumably) to the consideration of
the testimony and then announced
its verdict of acquittal. The result
Is not surprising for it has been
evident from the beginning that
the intention of those in charge of
this matter was to "whitewash"
"be accused officer. As for Major
Penrose himself The Herald can-
not blame him for using every ef-
fort possible to clear himself. The
worst this paper has ever said of
him is that he is insincere ' incon-
sistent incompetent for the grave
daties of the office which he holds.
It has nothing' to add to its meas-
ure of the man further than to say
that he has proven himself of en-
tirely too small calibre to uphold the
honor of the American army yet
lie has not fallen so low as Captain
Kilburn and some of his fellow of
ficers who have gone out of their
ncers wno nave gone oul ui men

way to perjure themselves and to I
heap insults upon the people of
.Brownsville.
JBut. aside from its effect in cov-
efing up and condoning the most
infamous crime that ever stained
the annals of the United States
army the Penrose trial and its re
suit are in effect a slap in the face
of President Roosevelt aud his rep-
resentatives Maj. Blocksom Col.
Covering Gen. Garlington and
Assistant to the Attorney General
Purdy each of whom after long
and careful examination of the
case declared that the soldiers un-
der ' Penrose's command were
.guilty. .
Yet after all the contention of
Penrose's counsel was not far
wr6ug when he claimed that the
charges had not been proven and
that not even the guilt of the sol-
diers had been established. The
fclame for this miscarriage of jus-
tice then lies partially at the door
of Capt. Charles E. Hay the judge
advocate for his weak and bungling
work in prosecuting the case. Capt.
Say however may be excused to
some extent when it is remember
ed that Penrose is his superior of
ficer belonging to the same branch
of the service and may some day be
Hay's colonel.
'The remainder of the blame must
lie at the door of the war depart
ment or whoever was responsible
for the appointment to the respon-
sible position of judge' advocate of
an officer who is of rank subor-
dinate to that of the man on trial.
Such a course can but make a mili-
tary trial a rank farce a mere
travesty upon justice.
The result of the Penrose trial
in the face of all the evidence which
could" and should have begin ad-
duced to sustain the charges against
aiiniand in the face of the action
6f -President Roosevelt in discharg-
3ng the soldiers who were under
Penrose's command but not under
his control can only make all hon
est-minded citizens have a con
tempt for milHary courts in gen
eral.
Now that one of the negrdes at
Brownsville has confessed to the
fact that the negroes did do the
shooting it may be expected that
Foraker- will try to impeach his
testimony Cuero Star.

South can do now is to look for a
soft place oh which to fall. Since
the ordnance experts have identi
fied four of the army rifles which
were used by Foraker's Cadets in
their murderous raid ou Browns
ville their sponsor cannot help but
foresee his defeat. Still he has
the consolation ' of knowing that
he has "made"good with the large
negro vote in the Northern states
and it is for that he has been play-
jng for that he was willing to
sacrifice the good name of a whole
Southern town and to heap up in
sult and infamy upon a people that

moros tomorrow. Not to attend the
bull fight though. ' Of course not.

purifying the blood. However as
n i ne tenths of people are accustom
ed to breathe they are not allowed
to perform half their necessary
work; and if- in addition to bad
habits indulged in through the
day while engaged in ordinary in-
door avocations a person sleeps in
a room without ventilation the ac-
tion of the lungs becomes so slug-
gish from the reduced amount of
oxygen in the air that with every
pulsation the biood grows heavier
more impure and the natural re-
sult is morning headaches sleep
that brings no rest and a fatigue
of mind as well as body that makes
the facing of the daily duties a

The automatic telephone has
been thoroughly tested and is a
pronounced success. The system
puts the hello girl entirely out of
commission as the man
wishing to talk to' an-
other party makes his own connec-
tion and there's no one to softly
sing out Lines busy . no one
to disconnect you until you gel
your say out; neither can they
"plug in" and listen while you
make a date with "Jonesy old
boy" to meet him at the club for
a quiet game of po-po- oh doml-
aoes! Neither will it be necessary
for one to take his letter out of the
church to pay his respects(?) to
i the operator who won't .connect

we're afraid the hello girl must go
in time. She's a dear sweet thing
and we love her; -we always have
and always will. We shall miss
