order hearing of January 29, the
suit also asks the court to enjoin
the various tax assessor-collectors
“from enforcing or attempting to
enforce the proported assessment
or collecting any taxes based upon
such proported assessment."
Additionally, it asks that the tax
assessors be ordered “to correct
the tax roles to reflect the property
assessed value of Plaintiffs' pro-

plying the approved tax rates to
the proper assessment.”
As evidence of his good faith,
Jones deposited with the court
more than $5,600 in estimated
taxes to be held in escrow until the
suit is settled.
Jones based his payments on the
estimated tax rates ATS placed on
the notices of property reappraisal
mailed in October.
Those rates were 22-cents per
$100 valuation for both the

Jones “and others met with the
Montague County Board of
Equalization, although not pro-
perly notified, and said Board of
Equalization reduced the valua-
tion of said inventory to $1.2
million, even though it failed to
consider evidence offered by the
Plaintiff as to the book value, the
fair market value, the tax returns
filed by the plaintiff and expert
opinion offered by the plaintiff."
The Appraisal District also set
the value of the 15.54 acre tract of
land and buildings at $575,880.
Jones states in the suit that the
inventory, as of Jan. 1. 1981, was
worth $200,000 while the 15.54
acres and four 100 by 200 foot
concrete floored, metal buildings
are worth a total of $275,000.
Jones recently rocked the local
business community by placing a
half page advertisement putting
the Nocona Texas Turbo Jet
facility and inventory up for sale
for $750,000 because of the high
property values set by the Ap-
praisal District and the actions
and alleged inactions of the Board
of Equalization.
The suit claims the Appraisal
District and Board of Equalization
failed to follow the provisions of
the Texas Constitution dealing
with "uniformity and equality in
taxation” and the “use of fair
market value" to set the values on
Jones’ buildings, land and inven-
tory.
The suit asks the district court
to enjoin the defendants “from
collecting or attempting to collect
the unlawful taxes based upon the
erroneous valuation of plaintiffs'
properties and from establishing a
tax lien on plaintiffs properties."

Secretary and Director of Mon-
tague County Farm Bureau.
In his new position, beginning
Jan. 4, 1982, Fenoglio will be
responsible for making commer-
cial, consumer and agricultural
loans. He will also coordinate the
development and implementation
of a marketing program for the
bank.
Fenoglio, his wife Judy and
children, Tabb, age 2 1/2 and
Crystal, age 1 1/2, live on their
farm near Montague. They are
members of St. William’s Catholic
Church.
In making the announcement
of the election of Fenoglio as Vice-
President of the First National
Bank of Nocona. Kenneth
Newcomb stated, "we are ex-

Fenoglio comes to the First Na-
tional Bank with over 11 years of
agricultural and commercial len-
ding experience. Having served
with the First National Bank of
Bowie and Vice President of
Graham National Bank of
Graham and Wichita Falls Pro-
duction Credit Association, he has
accumulated knowledge in most
phases of the banking industry.
A native of Montague and a
graduate of Bowie High School,
Fenoglio holds a B.B.A. degree
from North Texas State University
and a banking degree from the
Southwestern Graduate School of
Banking at Southern Methodist
University in Dallas. He has also
completed several coures from the
American Institute of Banking.
In the Bowie and Graham com-
munities. he has been active in
numerous organizations through
his service as President of Bowie
Kiwanis Club. President of Bowie
Young Farmers, Chairman of the
Montague County Heart Associa-
tion, Director and Treasurer of
Bowie Chamber of Commerce,
Young County’s Business Conser-
vationist of the Year, Chairman of
the Salvation Army of Graham,
Director of Graham Community
