•on why ihe antitrust act shouid ap-
ply to railroads at all. They are ou»
side the reach of the law, and not to
be within its terms. The publie in-
latest may be completely and thor-
oughly guarded through the interstate
act and through the Interstate omn-
merce commission and any additiona,
legislation respecting the rexulnti on or
railroads shou.d be adopted as amond-
ments to that law.
•Th* railroads must be encouraged
to keep pace witli the industry of the
c« untry. It is a lamentable fact that
rallroad facilities in recent years have
not responded to the comiercial
growth ‘of the country. While It is
tiue, however, that traffic agreements
and pools betwen railroads, now ef-
fected by the anti-trust act, ought not
to be forbidden, it is not true that a
necessary, condition to railroad im-
provement is that all governinentl su-
pervisfon shall • cease "

servants. The deqacy of their serv-
ice. the safety and compensntion of
their employes and the honest manage
ment of the business areqmatters of
public concern.
"The third consideration for any
amendment of the anti-trust act is
that it shall punish only where (he

pose of restricting competition or con
trolling prices In every criminal «tat
ute, the burden of the offense is the

poration ought not to condemn 1t$ The
chief evil which has induced popular
prejudice against comblnations of capi-

*cealed weapons in business that the
people complain of.
‘Fifth, no amendment of the anti,
trust act must make matters worse, by
paternalizing the attitude of the gov-
ernment toward private busi tew*.
