Common law marriages are recognized in several states
and Texas is one of those states that provides such recogni-
tion. However, Texas refers to common law marriage as an
“informal marriage.” There is a specific section under the
Texas Family Code that defines an “informal marriage.”
Under section 2.401 of the Texas Family Code, an “infor-
mal marriage” can be established either by registering with
the county without having a ceremony, or by meeting three
requirements. The three requirements are, 1. showing evi-
dence of an agreement to be married; 2. living together in
Texas; and 3. representation to others that the parties are in
fact married. The first two requirements are self evident as
to proving however the third requirement may be met by
the parties in various representation to include, but not lim-
ited to, referring to others as husband and/or wife, by hav-
ing house bills and living expenses in both parties names,
by having joint checking accounts and by buying cars or
houses in both parties names.
In order to register an “informal marriage”, a declaration
approved by the bureau of vital statistics must be signed.
Each party must provide proof of age and identity, and state
that they are not related to each other in any way. Finally,
they must agree to the printed declaration and oath found in
section 2,402 of the Family Code.
A new provision of the Family Code was added in 1995 that
states in part that either partner in a common law marriage,
or “informal marriage”, has two years after separating to file
an action to prove that the nuptials did exist.
There are two ways to end an “informal marriage.” If there
have been children or if property and debts remain undivid-
ed, you will want to seek advice from a competent divorce
attorney about a traditional divorce. However, if there are no
children or contested property, you can separate; and under
the new law, if neither person affirms that a marriage existed
within two years of the date when the parties stopped living
together in Texas, then it is assumed that the parties never
entered into matrimony. A party may still bring a claim that
a marriage did exist after the two year period has passed, but
the burden is upon that person bringing the claim and it is a
difficult burden to overcome. Please consult with a divorce
attorney to determine your particular circumstances.
For more information about whether you have an informal
marriage or are seeking to end an informal marriage, please

han at the Law Offices of Turner-Monahan, PLLC, at (817)

endar, and emailing the “Arts Express- This Week in Cleburne”
out every Thursday. The calendar is always available at http://

CFCA officers are Alden Nellis, president; Jim McHale, vice
president; and Greg Kauffman, treasurer. The Johnson County
Art Guild designed the logo. CFCA meets on the first Tuesday of
