Notice is hereby given that the reg-
ular annua! meeting of the stockhold-
era of the Chicago. Rock Island A Gult
Railway company will be held at the
general office of said company in the
city of Fort Worth, county of Tarrant.
State of Tex is, at 10 o’clock a. m.. on
Thursday, the 4th day of October, 1906.
for the purpose of electing a board of
"seven directors to serve for the ensuing
year and for the transaction of such
other busihess as may properly come
before said meeting. On the same day
and at the sane place, immediately
after the adjournment of said stock-
holders meeting, the regular annual
meeting of the board of directors of
aaM company will be held for the pur-
pose of electing a president, vice pres-
ident. se ret ary. treasurer and such
other officers as is provided by law.
and by the by-laws of said company,
and for the transaction of such other
business as may properly come before

E. .Smith of the Seventeenth district
court called the case of the State vs.
John Kaiser, the plaintiff announced
ready for trial. Counsel for the defend-
ant. however, asked fr a continuance,
owing to the fact that O. IL Buck was
not present. After hearing the applica-
tion Judge Smith transferred Iba case
to the Forty-eighth district court in
order that it muy be called during Oc-
tober.

the defendant had exercised diligence

Thia, he said, would give the defendant
ample time to gel in communication
with Mr. Rm k and would at the same
time give the state a speedy trial.

HON. IRBY DINKLIN, JUDGE.
A motion to re-form the order ol re-
sale of the Velasco, Brazos A Northern
Railroad company was filed in the
Forty-eighth district court yesterday
morning.
Under the original order made In
this case the road was wold at public
outcry at Angleton and the highest bid-
der paid in on his bid $10,000, the bal-
ance to be paid in accordance with the
ecree of Judge Dunklin. When the
date for the second payment to be made
arrived the purchaser failed to make
good and forfeited the 818.0*0 already
paid. This being suggested to the
court. Judge Dunklin ordered a resale
of the road to be made at Angleton.
Oct. 2, 1904. under the same conditions
as laid down for the first sal*.
The motion to re-form the second Or-
der of sale asks that the date of axle
be changed to a later day in order that
the purchaser at the original sale may
make good his first bid, which was ac-
cepted by ‘he special commissioner and
approved by the court. It is under-
stood that if the motion to re form the
order for a resale is sustained the
party whose bid was accepted at the
former sale will make that bid good.
