orable District Court of Chero-
kee County, at the Court House
in Rusk, Texas.
Said plaintiff's petition was fil-
ed on the 16th day of April,
1962.
The file number of said suit be-
ing No. 21971
The names of the parties in
said suit are:
C. H. NEAL, ET UX as Plain-
tiffs, and ALBERT M. SMITH,
ET AL as Defendants.
The nature of said suit being
substantially as follows, to wit:
Being a Trespass to try title
to the following described
premises,
FIRST TRACT: Part of the
Sarah Ann Duncan League,
one tract of 54 acres, former-
ly known as the Monk tract
of land and 25 acres being
part of the 937 acre tract of
land conveyed by Beauchamp
Brothers and Harding to the
Commissioners of the State
Penitentiary, said 54 acre
tract and 23 acres out of said
25 acre tract described by
metes and bounds as follows:
BEGINNING at the S.W. Cor-
ner of the 50 acre tract con-
veyed to W. C. Hall by G. O.
Smith et al;
THENCE N. 12 E. 600 vrs.
passing said Monk 54 acre
tract a hickory 4 in. for cor-
ner;
THENCE S. 85 W. with the
N.B. Line of said 54 acre
tract at 635 vrs. pass the N.E.
corner of said 54 acre tract,
and at 664 vrs. reach stake on
the right of way of St. Louis
Southwestern Railway of Tex-
as;
THENCE S. 6 E. 775 vrs. with
the right of way of said rail-
way to a road a stake for cor-
ner;
THENCE East with the said
road 406 vrs, to the place of
beginning, containing 77 acres
including all of the said 50
acre tract Monk tract, and 23
acres out of the said 25 acre
Beauchamp tract.
SECOND TRACT: Being two
acres adjoining the above said
FIRST TRACT out of the Sar-
ah Ann Duncan League, and
described as follows:
BEGINNING at the S.W. Cor-
ner of said W. C. Hall 50 acre
tract referred to above pur-
chased from Smith;
THENCE N. 85 E. 465 vrs. to
the S.E. Corner of said 50
acre tract;
THENCE South 40 vrs. to
stake in road;
THENCE West 463 vrs. with
paid road to the place of be-
ginning, containing 2 acres
of land and being the remain-
der of said 25 acres of land
above referred to.

to corner on Willis line, wit-
ness a hickory and a pine
each marked "X";
THENCE S. 15 E. with a
branch to the place of begin-
ning, containing 50 acres of
land, more or less.
If this Citation is not served
within 90 days after the date
of its issuance, it shall be re-
turned unserved.
