and duties, which makes this law clear-
ly unconstitutional and makes the as-
sessment of 1908 levied against the
1 railroads by this board invalid.
The further point is raised that the

service corporations with the assess- j

I state, which creates an inequality and j

strain the county treasurer and sheriff1
of Osage county from issuing warrants
i and selling its property for taxes. The |

treasurers .a nd sheriffs of Pottawato-
| mie, Oklahoma. Loogan, Payne, Lincoln!
Land Pawnee counties, the Santa Fei
1 । against the same officers of Iogan. (
, Woods and C"leveland counties, and the ’
| Fort Smith & Western against these i
officers in Lincoln, Logan and Cana-
dian counties, two sults being filed in
I Logan county . . I
! The railroads appeared before the
I state board of assessors at a recent
; meeting and proteste against the as-
sessment of last year being taken as a
• basis of the assessment for 1909 on
, similar grounds as presented in the
i suits filed in the circuit court today,
i but the state board subsequently an-
; I nounced a horizontal raise of 5 per |
! । cent over the assessment of 1908 on all .
