On Saturday, May 8, and on Monday. May Id, tins Company , through
its general manager lodged with your body verbal protest against any fur
ther work being done Hui summer in the bed of the Colorado River north
of the Bay City Markham county road bridge. We wish now to file this
more formal written protest and to most earnestly request that you take
all necessary steps to protect the nee farms asainst the serious loss which
is sur to result if thia work on the river lual is not discontinued imme
dlately.
We hardly deem is necessary to call your attention to the fact that
under the expressed provisions of the contract with Howard-Kenyon
Dredging Company, uch company has no legal right to provid'd with the

in view of the above provisions of the contract, there can be no doubt
that any work now attempted by the dredging company in the bed of the
river is in direct violation of the agreement and that the pilot ditch has
been and is now being dug in utter disregard of the contract and in breach
of its express provisions.
After a careful investigation of the whole situation, we wish to advise
you that any further work on the river at this time will seriously endanger
the water supply and most probably result in a total loss of the 1926 rice
crop to all farmers in your district. Markham Irrigation Company will,
of course, do its best to meet the situation, but from the present outlook
we will he unable to protect the rice growers if your board fails to exercise
jour legal rights and stop the work now being attempted by the dredging
company. For and on behalf of the rice farmers, we request that your
board give this matter immediate and earnest consideration and that you
take such steps in accordance with your contract with the Howard Kenyon
Dredging Company as will fully protect the interests of the farmers until
the 1926 rice crop is made. Failure on your part to meet the situation
promptly will have most serious consequences.
We write you this letter to call the gravity of the situation to your
special attention and advise you, and through you the rice farmers, that
unless something is done immediately Markham Irrigation Company can
not assume responsibility for the loss which the rice growers will suffer
on account of water shortage during the summer months
