Owners and operators of dual
wheeled vehicles were warned to-
day by Major R. A. Crowder, com-
mander of Region 5, Department
of Public Safety, that certain ve-
hicles must be equipped with mud
flaps or guards on the rear axles
or face enforcement action by the
courts.
The new law requires flaps or
guards on road-tractors, trucks,
trailers, and semi-trailers operat-
ed on public highways if the rear-
most axle of the vehicle has four
tires or more.
Crowder instructed the DPS pa-
trolmen in his region to start is-
suing traffic citations against all
violators of this law immediately.
Crowder pointed out that the
mud flaps must be constructed of
metal, rubber, rubberized mate-
rial, or any other substantial sub-
stance. The safety guards or
flaps must be at least as wide as
the tires behind which they are
suspended or attached and must
be of sufficient rigidity to remain
within 8 inches of the surface of
the highway under any conditions
of loading in order to prevent
slush, mud, or gravel being trans-
mitted from the vehicle’s rear
wheels to the windshield of any
following vehicle.

an old mud flap law requiring the
use of mud flaps in wet weather.

You can give some of your rights
to other people, for example, the
right to collect a bill; but it’s a
different thing with your duties.
You need your creditor’s OK firm-
ly to assign your debts to another.
You can sell what you own, • all
right, but you can’t shake a debt
merely by getting somebody else
to promise to pay it for you. Your
creditor—who is a party to your
contract—has something to say
about who takes over your obli-
gations.
Thus, your cousin, say, borrows
from you and promises to pay the
money back. He can’t get out of
it by getting his neighbor to say
he will pay you for him unless you
agree—and this takes a written
contract.
Suppose you bought Abel’s house
on time for $15,000 and had paid
off $5,000. Then, with $10,000
left to pay, you get Joe Smith to
buy the place.
How could Smith pay you for it?
Well, for Smith it would be just
dandy for you to let him take over
the $10,000 debt, pay you back
your $5,000 equity, and then pay
off Abel the rest of your $10,000
debt. Smith would save the cost
of a new loan—if his credit was
good enough to get one in the
first place. So you set it up that
way.
One day Smith blew; and you,
yes you, hold the bag. True, you
could turn over your equity to
Smith without Abel’s consent.
But your agreement with Smith
to pay the balance is not binding
on Abel. He can hold you to your
original deal. Pay up $10,000.
Don’t let someone “assume” your
loan unless you protect yourself
by an agreement with your lender,
or unless you are willing to risk
holding the sack.
Your buyer is often a good
enough risk for you to let him as-
sume the loan — but don’t do it
thinking you are free of your debt.
