It didn’t take Austin County commissioners long Monday to
act favorably on a petition to call a stock law election.
The request also received support from individual commission-
ers as well as from sheriff’s deputies who apparently are getting
tired of midnight round-ups and fence patching.
The proposition will appear on the ballot on Saturday, May 1,
along with the unit road system question. It will read, in part, as
follows:
“... an election in Austin County for the purpose of determin-
ing if cows, horses, hogs, sheep or goats shall be permitted to run
at large in the unincorporated areas of Austin County,* Voters,
in marking a ballot, will be required to indicate which of the five
classes of livestock they wish to be included on the prohibited
list.
Should the proposal lie adopted. the penalty, if a person know-
ingly permits the class (classes) of animal(s) to run at large, it is
a Class C misdemeanor punishable upon conviction by a fine not
to exceed $500.
“This amendment to the current stock law, if it passes, will
allow the sheriff to write tickets for animals that continue to
wander around Austin County roads,” said County Attorney Dan
Leedy. He added that it will put teeth into current legislation
that provides for the sheriff to round up the stray livestock and
confine them to a stockpen until retrieved by the owner.
Currently the only penalty requires the owner to pay for the
actual round-up and other expenses such as feed and water dur-
ing confinement.
The only other item on Monday’s short agenda was considera-
tion of a letter from San Bernard Electric Cooperative, request-
ing permission to place a 14.4 KV distribution power line across
Mill Creek Road. The court found no objection and granted per-
mission unanimously.
