1 AN ACT 2 relating to the extent of extraterritorial jurisdiction of certain 3 municipalities. 4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 5 SECTION 1. Section 42.021, Local Government Code, is 6 amended to read as follows: 7 Sec. 42.021. EXTENT OF EXTRATERRITORIAL JURISDICTION. (a) 8 The extraterritorial jurisdiction of a municipality is the 9 unincorporated area that is contiguous to the corporate boundaries 10 of the municipality and that is located: 11 (1.) within one-half mile of those boundaries, in the 12 case of a municipality with fewer than 5,000 inhabitants; 13 (2) within one mile of those boundaries, in the case of 14 a municipality with 5,000 to 24,999 inhabitants; 15 (3) within two miles of those boundaries, in the case 16 of a municipality with 25,000 to 49,999 inhabitants; 17 (4) within 3-1/2 miles of those boundaries, in the 18 case of a municipality with 50,000 to 99,999 inhabitants; or 19 (5) within five miles of those boundaries, in the case 20 of a municipality with 100,000 or more inhabitants. 21 (b) Regardless of Subsection (a), the extraterritorial 22 jurisdiction of a municipality is the unincorporated area that is 23 contiguous to the corporate boundaries of the municipality and that 24 is located within five miles of those boundaries on the barrier
