Nicholson, a member of the Wichi:

his membership and sought relief in
the eighty-ninth district court. The
trial court held the committee acted
without authority in removine a
member who had been elected by the
people.
The judgment of the appellate
court Saturday reversed the ease and
holds the committee did not go out
of the bounds of Its authority. Ed-
gar Scarry, chairman of the commit-
tee, was the appellant. He was sued
by Nicholson who tried to regain
his sest and when the trial court
held in favor of Nicholson, Scurry
appealed.
Nicholson sought an injunction to
prevent his suecessor occupying the
seat ia the committee.
"There are grounds well supported
by the authorities upon which tbs
court below should have denied the
appellee (Nichelson) the injunctive
relief that he cooks. Injunctive re-
lief le granted by the oourts upon
equitable grounds only, and it is a
maxim of equity that ’He who comes
into a court of equity, must come
with clean hands',” states the opinion
of the second court of civil appeals,
which was written by Chief Justice
Coanor.

cratic primary seeks a position as

Laredo to attend a banquet to be
given tonight by the Laredo Times,
recently taken over by the Marsh-

a similar award is to be made in
1929, according to the plane ef the
couneil.
, At the Friday night mooting of the
Amarillo couneil, U. C. T, a resolu-
tion of appreciation was passed for
the courtesy of CoL Ernest O. Thomp:
