Grogan L. Howell and wife, Chollis L. Howell, both of Travis County in the State of Texas
Parties of the second part, WIINESSEFH:

1. That the said party of the first part, for the consideration hereinafter men-
tioned, hereby agrees and binds himself well and truly to construct, erect, finish, com-
pie te and deliver in a true and perfect workmanlike manner a 2 story residence constructe
of 8 inch masonry walls with built up and tile roof, and a one story frame and stucco
double garage according to plans ana specifications agreed upon by and between the parties
hereto, signed by the parties hereto for identification, and made a part of this contract
for the said parties of the second part, upon all that certain tract or parcel of land
lying and being situated in Travis County, Texas, and described as follows, to-wit:

Lot No. Three (3), in Block "0", of Shelley Heights, a subdivision of a portion of tl
South one-half of Outlet Seven (7) in Division "Z" , of the City of Austin, Travis County,
Texas, according to map or plat of said Subdivision which is of record in Mat Book 3,
page 240 of the Plat Records of Travis County, Texas;
and to furnish and provide first class work and materials for all parts thereof that me y
be necessary for the full completion of the said improvements, according to the said plans
and specifications, that the said party of the first part hereby agrees to be responsible
for any damage that may happen to the said improvements in the course of erection from fii
or from any other cause whatever, until the same have been completed by the said party
of the first part, according to the said plans and specifications turned over to and ac-
part to the said party of the first part as hereinafter provided.

cepted by the said parties of the second part ; that the said party of the first part hereby
agreed and binds hi ms. elf to pay for all materials and labor used in andperformed on the sQid
improvements as the same accrue, and to have the said improvements completed according to
the said plans and specifications, and ready for occupancy on or before ninety (90) working
days free from any and all claims on the part of any -and all persons for materials and lai or
used in and performed on the said improvements for the sum of Seven Thousand, Eight Hundred
appeared Roy Bedichek and wife, Lillian G. Bedichek, known to me to be the persons whose
names are subscribed to the foregoing instrument, and acknowledged to me that they executed
the same for the purposes and consideration therein expressed. And said Lillian G. Bedichek,
wife of said Roy Bedichek, having been examined by me privily and apart from her husband,
; and having the same fully explained to her, she, the said Lillian G. Bedichek, acknowledged
such Instrument to be her act and deed, and declared that she had willingly signed the sane
for the purposes and consideration therein expressed, and that she did not wish to retract
it.
