The Charter and By-Laws of said Company are expressly made a part of this instrument,which

said Trustee from Travis County, Texas, or his refusal or failure, or inability to act, then
such person as may be appointed by instrument in writing executed by the President of said
Company, shall be and is hereby appointed and made successor in trust to the said Trustee,
with all the powers hereby conferred upon the said Trustee.
