perty hereby conveyed constitutes their homestead, and that no part of such property is
exempt from writ of execution under the Constitution and laws of the State of Texas; and
they state that they now own, occupy, and use, as their residence, and they do hereby dec
signate as their residence homestead, the following described real property, situated in
Travis County, rexas, to wit: the North 93 feet of the West 96 feet of Lot No. 8, in
Block No. 128, in the City of Austin, Travis County, Texas.

proceed to sell the property herein conveyed, or any part thereof, at public vendue, to
the highest bidder for cash, at the court-house door of Travis County, Texas, between the
hours of 10:00 o’clock A. M., and 4:00 o’clock P. M. on the first Tuesday in any month, Filst
giving three weeks’ public notice of the time, terms, and place of sale, and of the proper y
to be sold, by posting or publishing notices of such sale as required by law in sales unde:*
any deed of trust or other contract lien. Upon such sale, the said Jay II. Brown, Trustee,
shall execute and deliver a deed or deeds of conveyance, in fee simple, to the purchaser
or purchasers thereof, with full covenants of warranty of the property sold, and shall re-
ceive the proceeds of said sale, out of which shall be paid, (1) the costs and expenses
of executing this trust, including compensation to the said trustee amounting to 21% of
the total amount received from said sale, *(2) all taxes of every kind which may be due, or
which may have become an encumbrance or lien on the property herein conveyed, (3) all sums
of money which may have been paid by the holder of said note for taxes on said property
herein conveyed, or for any other purpose as herein provided, during the continuance of
this deed of trust, with all interest which may be due thereon, (4) the principal and in-
terest then due and remaining unpaid on the said promissory note, together with all attor-
ney’s fees that may have accrued thereon, and (5) the remainder, if any, shall be paid to
us, or our legal representatives. We agree that said sale shall be a perpetual bar against
